What does it do?
- Made under the Civil Service Act, 2049, these rules form the Nepal Education Service, a civil service for education officials. It has seven groups: Teaching, Education Administration (with English, Nepali, Sanskrit, Science, Mathematics, Social Education, Vocational Education, Physical Education and Inspection subgroups), Printing Management, Art, Archaeology, Testing and Evaluation, and Library Science. Gazetted classes run from special to third class, and non-gazetted classes from first to fourth.निजामती सेवा ऐन, २०४९ अन्तर्गत बनेका यी नियमले नेपाल शिक्षा सेवा गठन गरेका छन्। यसमा अध्यापन, शिक्षा प्रशासन (अङ्ग्रेजी, नेपाली, संस्कृत, विज्ञान, गणित, सामाजिक शिक्षा, व्यावसायिक शिक्षा, शारीरिक शिक्षा र निरीक्षण उपसमूहसहित), मुद्रण व्यवस्थापन, कला, पुरातत्व, परीक्षण तथा मूल्याङ्कन र पुस्तकालय विज्ञान गरी सात समूह छन्। राजपत्राङ्कितमा विशिष्टदेखि तृतीय श्रेणी र राजपत्र अनङ्कितमा प्रथमदेखि चतुर्थ श्रेणी रहन्छन्। Nepal Law Commission Rules 3 and 4(1)-(4), PDF pp. 1-3; Schedule 1, PDF p. 6
- Vacancies are filled under Section 7(1) of the Act, and posts without a class are filled by open competition. To apply, a person must not be disqualified under Section 10 of the Act and must hold the minimum qualification in Schedule 3. For example, gazetted first and second class posts in Education Administration need a master's degree in education plus the experience set by the Civil Service Regulation, and gazetted third class posts need a bachelor's in education with the relevant main subject.रिक्त पद ऐनको दफा ७(१) बमोजिम पूर्ति हुन्छ र श्रेणीविहीन पद खुला प्रतियोगिताबाट पूर्ति गरिन्छ। उम्मेदवार हुन ऐनको दफा १० बमोजिम अयोग्य नभएको र अनुसूची-३ बमोजिमको न्यूनतम योग्यता पुगेको हुनुपर्छ। जस्तै, शिक्षा प्रशासन समूहको राजपत्राङ्कित प्रथम र द्वितीय श्रेणीका लागि शिक्षाशास्त्रमा स्नातकोत्तर र निजामती सेवा नियमावलीबमोजिमको अनुभव तथा तृतीय श्रेणीका लागि सम्बन्धित मूल विषय लिई शिक्षाशास्त्रमा स्नातक चाहिन्छ। Nepal Law Commission Rules 6(1)-(2) and 7, PDF p. 4; Schedule 3(क)-(ख), PDF pp. 14-16
- Staff are transferred only to posts within their own group or subgroup, subject to Chapter 4 of the Act and Chapter 6 of the Civil Service Regulation. Promotion requires the educational qualification under Section 24घ of the Act, but for staff already serving before 2050 Magh 18, the qualification set for their entry counts as the minimum. The Ministry of Education runs the service, coordinating with the Ministry of General Administration on policy.कर्मचारीलाई ऐनको परिच्छेद ४ र निजामती सेवा नियमावलीको परिच्छेद ६ को अधीनमा रही आफ्नै समूह वा उपसमूहभित्रको पदमा मात्र सरुवा गरिन्छ। बढुवाका लागि ऐनको दफा २४घ बमोजिमको शैक्षिक योग्यता चाहिन्छ, तर २०५० साल माघ १८ गतेअघि बहाल रहेका कर्मचारीका हकमा प्रवेशका बेला तोकिएको योग्यतालाई नै न्यूनतम मानिन्छ। नीतिगत विषयमा सामान्य प्रशासन मन्त्रालयसँग समन्वय राखी शिक्षा मन्त्रालयले सेवा सञ्चालन गर्छ। Nepal Law Commission Rules 8, 9 and 10, PDF pp. 4-5
- When the rules began, staff in the old teaching, printing, painting and photography, test and measurement and library science groups were moved into the new groups and subgroups. The Second Amendment, 2069 converted the posts of Graduated Civil Master and Civil Master into School Inspector, Technical Assistant and Nayab Technical Assistant in the Inspection subgroup. The rules repealed the Education Service rules of 2016 and 2033, and the government may change the schedules by notice in the Nepal Gazette.यी नियम प्रारम्भ हुँदा पुराना अध्यापन, मुद्रण, पेन्टिङ तथा फोटोग्राफी, परीक्षण तथा मापन र पुस्तकालय विज्ञान समूहका कर्मचारीलाई नयाँ समूह र उपसमूहमा समूहीकृत गरियो। दोस्रो संशोधन, २०६९ ले ग्याजुएटेड सिभिल मास्टर र सिभिल मास्टरका पदलाई निरीक्षण उपसमूहको विद्यालय निरीक्षक, प्राविधिक सहायक र नायब प्राविधिक सहायक पदमा परिणत गर्यो। यी नियमले २०१६ र २०३३ का शिक्षा सेवासम्बन्धी नियम खारेज गरेका छन् र नेपाल सरकारले नेपाल राजपत्रमा सूचना प्रकाशित गरी अनुसूची हेरफेर गर्न सक्छ। Nepal Law Commission Rules 5(1)-(2), 11 and 12, PDF pp. 3-5; note on Rule 6 of the Second Amendment, 2069, PDF p. 5
