What does it do?

  • These rules, made under Section 14 of the Explosive Substance Act, 2018, set six kinds of licence: to sell, to use, for a foreman, for laboratory research, to import, and to transport explosives. An importer who also wants to sell needs a selling licence as well. Applicants must use the Schedule-4 form and apply to the Chief District Officer; a licence may be given to a person aged 21 or over who is found qualified and trustworthy. A foreman's application needs a recommendation from the licensed employer. Nepal Law Commission Preamble, Rule 3(1)(क)-(च) and Rule 4(1)-(3), PDF pp. 1-3
  • The Chief District Officer decides on selling, use, foreman and transport licences after a police report and, if needed, an expert opinion, and must tell the applicant and the Ministry of Home Affairs if a licence is refused. Import and laboratory licences go to Government of Nepal through the Ministry of Home Affairs. A licence lasts until the end of Chaitra of that year. The fee is Rs 3 (it may be waived for approved educational institutions or laboratories) and renewal costs Rs 1. A licence cannot be transferred, and it may be cancelled for breaking the Act or rules. Nepal Law Commission Rules 5(1)-(3), 6(1)-(3), 7(1) and 8, PDF pp. 3-5
