What does it do?

  • These rules let the government lease out the right to catch fish and other aquatic animals. The relevant government department may lease the right to catch or kill specified species in a specified body of water for a set period, and does so through its fisheries section. The government keeps the final say on whether any water or aquatic animal is leased at all, and may make other arrangements instead. Nepal Law Commission Rules 3, 4 and 6(3), PDF pp. 1-2
  • Leases are awarded by open bidding. Anyone who wants a lease must attend the bidding on the set day, in person or through a representative; a higher offer made later is not considered. A lease runs for 3 to 5 years at a time, depending on the place, and cannot be extended without new bidding. Lease income must be deposited each year at the Rastra Bank or the district revenue office in the fisheries section's name, and the deposit voucher sent in. Nepal Law Commission Rules 5, 6(1)-(2) and 7, PDF p. 2
  • A lease may carry conditions. Fishing with substances or methods banned by the Aquatic Animals Protection Act, or by blocking a stream to catch fish, is not allowed. Sahar (mahseer), rohu, naini mrigal and kalla fish under 12 inches may not be caught and must be released if netted. Only rods and nets may be used. The contractor must give local fishermen priority, and officials may inspect the leased waters at any time. Nepal Law Commission Rule 8(क)-(च), PDF pp. 2-3
  • If a contractor breaks the lease conditions, the contractor must pay for the government's losses plus any penalty under the law, and the department may cancel the lease and award it to someone else; the local officer decides whether there was a breach and how much damage was done. The government may ban fishing in leased waters during breeding periods. It may also end a lease in the public interest with one month's notice (or by notice in the Nepal Gazette in special circumstances), refunding the amount it decides and, where reasonable, compensation. Nepal Law Commission Rules 9, 10 and 11(1)-(2), PDF p. 3
