Stadium (Rent) Rules, 2018

What does it do?

• These Rules govern renting the stadium at Tundikhel in Kathmandu for sports, military displays, circus, music, scientific or cultural shows. Anyone who wants to hold a show must apply to the designated officer at least 7 days ahead, stating the purpose, dates and times. The officer may then issue a licence in the Schedule's format. No licence is issued until the applicant signs a bond agreeing to pay whatever is due if the licence terms are broken.यी नियमहरूले काठमाडौँ टुँडिखेलस्थित रङ्गशालामा खेलकूद, सैनिक रमिता, सर्कस, सङ्गीत, वैज्ञानिक वा साँस्कृतिक प्रदर्शन गर्न बहालमा दिने व्यवस्था गरेका छन्। प्रदर्शन गर्न चाहने व्यक्तिले उद्देश्य, अवधि र समय खुलाई कम्तीमा ७ दिनअगाडि तोकिएको अधिकारीसमक्ष दरखास्त दिनुपर्छ। तोकिएको अधिकारीले अनुसूचीको ढाँचामा इजाजतपत्र दिन सक्छ। इजाजतपत्रका शर्त पालना नगरे बुझाउनुपर्ने बुझाउने कबुलियत नगराई इजाजतपत्र दिइँदैन। Nepal Law Commission Rules 2 and 3, Rule 4(2), Schedule; PDF pp. 1-3, 6
• Rent is Rs 50 a day. Half must be paid before the licence is issued and the rest within 7 days after the show ends; after that, it can be paid within one more week with a 2 percent charge, and if still unpaid the Chief District Officer recovers it as government arrears. Shows for national health or cultural purposes pay Rs 25 a day if tickets are sold, and nothing if they are free and raise funds for a public body or social work. • If costs exceed income or natural or other events make payment hard, the Ministry of Defence may waive up to 25 percent of the rent. A record of each waiver, with the income and spending details and reasons, must be sent within 35 days to the Auditor General's department, the Income Tax Department and the Financial Comptroller General Office. No reduction is given unless the designated officer is satisfied that a show is truly for national health or cultural purposes.आम्दानीभन्दा खर्च बढी भएमा वा प्राकृतिक वा अप्राकृतिक कारणले बहाल बुझाउन मर्का परेमा रक्षा मन्त्रालयले मनासिब ठहराए कुल बहालको बढीमा २५ प्रतिशतसम्म मिनाहा हुन सक्छ। मिनाहा भएको बहालको अभिलेख आम्दानी खर्चको विवरण र कारणसहित ३५ दिनभित्र महालेखा परीक्षकको विभाग, आयकर विभाग र महालेखा नियन्त्रक कार्यालयमा पठाउनुपर्छ। प्रदर्शन वास्तवमै राष्ट्रिय स्वास्थ्य समृद्धि वा साँस्कृतिक उत्थानका लागि हो भन्ने विश्वास तोकिएको अधिकारीलाई नभई बहाल मिनाहा हुँदैन। Nepal Law Commission Rules 5 and 9, PDF p. 3
• The Government may change, suspend or cancel a licence without giving reasons, but must notify the holder at least 24 hours before the show, and no rent is charged for the suspended period. The licence holder is responsible for preventing damage to the grounds and government property, and must compensate any damage caused deliberately or by negligence, based on a recommendation from the Nepali Army's engineering department.नेपाल सरकारले स्पष्टीकरणबिना नै इजाजतपत्रको अवधि र समय हेरफेर गर्न, स्थगित गर्न वा निष्क्रिय गर्न सक्छ, तर प्रदर्शन हुनुभन्दा कम्तीमा २४ घण्टाअगाडि सम्बन्धित व्यक्तिलाई सूचना दिइन्छ र स्थगित अवधिको बहाल लाग्दैन। रङ्गशाला र त्यहाँका सरकारी मालसामानको नोक्सानी हुन नदिने जिम्मेवारी इजाजतपत्रवालाको हुन्छ र जानाजान वा लापरबाहीले भएको नोक्सानीको क्षतिपूर्ति नेपाली सेनाको इन्जिनियर विभागको सिफारिसअनुसार तिर्नुपर्छ। Nepal Law Commission Rules 7(2)-(4) and 8, PDF p. 4
