What does it do?

  • The Chief Justice assigns judges from the district court to the children's court. The court hears cases about offences committed by children and cases seeking punishment for breaking the Act Relating to Children, 2075 (except those under Section 72(8)). The judge decides together with a social worker and a child psychologist or child expert, but the judge's view prevails on questions of law. Cases involving an accused child or a child victim are heard in closed court, open only to the child's family or guardian, lawyer and people the court allows. Nepal Law Commission Rules 3, 4 and 50(1), PDF pp. 3-4, 31
  • An investigating officer who needs to take a child into control must first get the court's permission and then inform the child's family, guardian or a close relative. Keeping a child in an observation room also needs court permission; if the court finds it unsuitable, it may hand the child to parents, family, a guardian, a social organisation or a child correction home. Before allowing it, the court checks the child's identity was kept confidential, health was examined, and the child could get counselling and a lawyer. If a child in custody was beaten or tortured, the court may order departmental action against the person responsible. Nepal Law Commission Rules 9, 11, 14 and 15(3), PDF pp. 5-9
  • A person unhappy with a diversion decision made by the investigating officer or government attorney may appeal to the children's court within 30 days, and a diversion decision of the children's court may be appealed to the High Court within 30 days. Cases are sorted into simple, general and special tracks, which should normally be decided within six months, one year and one year and six months respectively. If victim and child agree, the court may start a restorative justice process; the facilitator's agreement is carried out once the court approves it. Nepal Law Commission Rules 31, 61(1)-(4) and 64(4), PDF pp. 22, 37-40
  • Each court must have paid lawyers to help children who cannot afford a lawyer, are helpless, or are in an observation room or child correction home. They are chosen by open competition after a public notice of up to 30 days, serve one-year terms, and may read case files and take copies free. Social workers and child psychologists are appointed the same way from people listed with local child rights committees, also for one-year terms, and may be removed for misconduct or being absent without reason for more than 15 days in a row. Nepal Law Commission Rules 39-42 and 88-90, PDF pp. 26-27, 48-50
  • People other than the child pay fees for copies of case papers: Rs 10 per A4 page copied by the court, Rs 5 per page if they copy it themselves, Rs 20 for a copy of the case summary book, and Rs 5 per photo of a document. Copies are certified only after the fee is paid. If a child's age is in doubt, it is fixed from documents under Section 83 of the Act or, failing that, by a test at a government hospital, with the court paying the test fee. Nepal Law Commission Rules 71 and 87, PDF pp. 43, 48
