What does it do?

  • Children may form child clubs to protect and promote child rights, reflecting local diversity; children with disabilities and girls may form their own clubs. A club must register with its local level, with no fee, and renew within three months after each fiscal year ends. Clubs may not handle money, donations or transactions, join or campaign for a political party, or force any child to join. A club that does not renew for three fiscal years has its registration cancelled. Nepal Law Commission Rules 3(1)-(6), 4(1), 5, 6, 8 and 9, PDF pp. 2-4
  • A child correction home may admit a child in conflict with the law only on a court order, and must record the child's family contacts, health and belongings and explain the child's rights, case and the rules in a child-friendly way. Boys and girls must be housed separately, children under 14 apart from those aged 14 to 17, and those whose case is pending apart from those serving a decision. Food quality must be tested at least every six months, girls given sanitary pads, and each child at least two sets of clothes per season. Nepal Law Commission Rules 18(1)-(3), 21 and 23(1)-(5), PDF pp. 6-9
  • An organisation that wants to run a child home must be a registered non-profit with that aim in its charter, have child-friendly facilities able to care for at least twenty children, secure funding and staff, and child protection standards. It applies to the National Child Rights Council, which may grant permission; the home must renew within three months after each fiscal year and meet the minimum standards in Schedule 4. If a home falls short, the Council may give up to three months to fix it, then cancel its permission and move the children to another home. Nepal Law Commission Rules 62(2)-(10) and 64(1)-(2), PDF pp. 28-30
  • Long-term child homes must care for children until they turn 18, then help them live independently or return to their families. Reunification must follow a social worker and child psychologist's assessment, be done in the presence of a local-level representative, and the family must sign that it will not send the child back to a home. If a child cannot be reunited, the home must arrange alternative care. Local child rights committees must regularly monitor child homes and correction homes are monitored by district child justice committees. Nepal Law Commission Rules 44(1), 63(3), 65(1)-(5) and 67(1), PDF pp. 18, 30-31

Gaps, loopholes and improvement ideas

  • Not enforced Many child homes fall short of the standards this regulation sets. Citing Rules 64, 67 and 69, the Auditor General reported that of 207 child homes, 98 were caring for 2,221 children (945 boys and 1,276 girls); 56 operating homes had fewer than 20 children, and two homes in Sindhupalchok and Kavre had no children at all. Only 11 homes were well equipped; 64 met the standards but needed improvement, 23 did not meet basic standards and 2 met none, and these were recommended to the Ministry for action. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd Annual Report, National Child Rights Council, para 14, printed p. 349 (PDF p. 381); Rules 62(4)(ग), 64, 67 and 69, PDF pp. 29-33
