What does it do?
- The Government of Nepal made this regulation under Section 50 of the National Identity Card and Vital Registration Act, 2076. It replaced the Birth, Death and Other Personal Events (Registration) Rules, 2034 and has been amended twice, most recently in 2082. The Department of National ID and Civil Registration builds and runs the national identity management information system, and service providers must connect to it once identity cards are in force. Nepal Law Commission Title page and preamble, PDF p. 1; Rule 3, PDF p. 2; Rule 39, PDF p. 25
- A citizen applies for the national identity card to the local officer (Schedule 1) within the period set in Section 7(1) of the Act. They bring the original citizenship certificate, plus proof of date of birth if it is missing, and migration or marriage certificates where the address or spouse differs. A person eligible for citizenship but without a certificate can also apply (Schedule 2). The applicant must appear in person to give biometric data, and the originals are returned. A random ten-digit number is generated automatically. The Department issues the card, which must be collected in person. The late fee is Rs 200 and a duplicate card costs Rs 500. Nepal Law Commission Rule 4(1)-(10), PDF pp. 2-3; Rules 6-7 and 9, PDF pp. 4-5; Rule 13, PDF p. 8; Schedule 3 items 1-2, PDF p. 35
- Births, deaths, marriages, divorces and migration are reported on set forms to the local registrar's office (usually the ward office). The forms are free and may be filed online. If there is no one with the duty to inform, a guardian or the ward chair reports the event. A divorced woman can register events at her own permanent address. Children living with their mother can be registered at the mother's address, and births to women serving sentences in prison are reported through the prison office. Registering after the legal deadline costs a Rs 200 late fee in Nepal (USD 25 at a Nepali mission). These fees go to the local government's revenue account. Nepal Law Commission Rule 16(1)-(13), PDF pp. 8-10; Rule 17(1)-(2), PDF pp. 10-11; Rule 35(1), PDF pp. 23-24; Schedule 3 item 3, PDF p. 35
- A parent or guardian can get a minor's national identity card for a child by applying with the birth certificate and a parent's identity number or citizenship certificate. If both parents are untraceable or dead, the documents required for citizenship are used instead. For children under ten, only a digital photo is taken as biometric data. Nepal Law Commission Rule 11(1)-(5), PDF pp. 5-6
- The Department runs the data bank under security standards; for example, the master key of the identity system is split among three different bodies. With Ministry approval, public or private bodies can use the system to verify identity numbers, personal or biometric details or cards. Each check costs Rs 5, Rs 10 or Rs 20, and government bodies pay nothing. Government systems for passports, land, vehicles, driving licences, vital registration, social security, revenue and citizenship can be linked directly. The Election Commission can receive data online to update the voter list. Individuals must be able to find out who used or viewed their data in the last six months. Nepal Law Commission Rules 29-30, PDF pp. 20-23; Rule 32, PDF p. 23; Schedule 3 item 6, PDF p. 36
Gaps, loopholes and improvement ideas
- Capacity Most cards have not reached people. The Home Administration Reform Action Plan, 2078 aimed to collect details of 20 million citizens and hand out 10 million national identity cards within two years. The Auditor General's 62nd report found that by the end of the audit period 15.207 million records had been collected and 4.328 million cards printed, but only 867,000 (20%) had been handed out. The 63rd report found that by the end of Asar 2082, 18.112 million records had been collected, 7.208 million cards printed and 2.906 million handed out. Both reports said the work should be finished on time as the plan set out. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd report, Ministry of Home Affairs chapter (Department of National ID and Civil Registration), para 19, printed p. 306 (PDF p. 336); OAG 63rd report, same chapter, para 19, printed p. 268 (PDF p. 300); Rules 5-6 and 9, PDF pp. 3-5
- Capacity Record systems are causing service delays. The Auditor General's 63rd report cites Rule 29 (the data bank) and Rule 30(6) (giving social-security systems access to the identity system). It found that the systems in use were not regularly maintained or upgraded and that senior citizens' fingerprints often did not match. It also found that retina scanners were lacking and that uploaded documents disappeared on their own because the systems were not linked, so they had to be uploaded again. Together with data mismatches, this was delaying services. The report says the systems should be upgraded and these problems fixed. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd report, performance audit 'Effectiveness of the social security allowance programme', finding 1, printed p. 596 (PDF p. 632); Rules 29 and 30(6), PDF pp. 20-22
- Unclear Late fees for vital registration differ from place to place. The Auditor General reviewed local governments' vital-event registration fees for FY 2079/80-2081/82. Kathmandu Metropolitan City charged Rs 50 per event registered after 35 days, while other sampled local governments charged amounts between Rs 50 and Rs 300, for example Rs 150 in Likhu Rural Municipality and Rs 200 to Rs 300 in Chandragiri and Baglung municipalities. Schedule 3 of this regulation sets the late fee for vital-event registration in Nepal at Rs 200 (Rule 17(2)). The report cites Section 7 of the Act, not this regulation. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd report, performance audit of local-level revenue administration and collection, para 6.5, printed p. 648 (PDF p. 684); Rule 17(2), PDF p. 11; Schedule 3 item 3, PDF p. 35
- Not enforced Birth registration fails when the father is absent. The UN CEDAW Committee noted in February 2025 that the National ID and Civil Registration Act (2020) and this Regulation (2021) allow births to be registered by the mother or the father. Even so, it found that in practice birth certificates are often not issued when the father is missing or unidentified, which increases children's risk of statelessness. It also noted that, according to the 2021 census, 26% of children under five had no birth certificate. UN Committee on the Elimination of Discrimination against Women · Nepal Law Commission CEDAW/C/NPL/CO/7, para 34(b)-(c), PDF p. 11; Rules 16-17 and 20, PDF pp. 8-12
Ideas to fix it
- Upgrade the information systems used for records so they meet current needs, fix the problems found (fingerprint matching, missing retina scanners, documents disappearing after upload) and make service delivery effective. Proposed by: Office of the Auditor General Office of the Auditor General, Nepal
- Ensure universal birth registration for all children regardless of their parents' legal status, including children of stateless women, refugees, migrant women and women sex workers. Proposed by: UN Committee on the Elimination of Discrimination against Women UN Committee on the Elimination of Discrimination against Women
