What does it do?
- Government bodies must place their advertisements and notices through the Advertising Board: the advertiser picks the media outlets and enters the order in the Board's online system, and the Board arranges publication quickly. A government body may hire an advertising agency under procurement law where the content or technical work needs one. Public-welfare advertisements go to the Board, which shares them among media in proportion to factors such as circulation, reach, citizens' access, and outlets run by or in women, Dalit or other marginalised communities or areas. Nepal Law Commission Rules 5ग(1)-(5) and 6(1)-(2), PDF pp. 5-6
- To place government advertising, the Board grades media outlets by factors such as circulation, broadcast reach and digital audience, asks them each year for their rates, may negotiate rates that look unusually high or low, and publishes the agreed rates. Outlets that do not give rates or will not work at the agreed rate get no government advertising. Government bodies pay on the outlet's or agency's bill at those rates, after deducting the amount Section 21(2)(b) of the Act sets for the Board's fund. The fund also receives 3 percent of government advertising spending. Nepal Law Commission Rules 5ख(1)-(5), 6क(1)-(4) and 13(1)(ख), PDF pp. 4-6, 12
- Local governments permit hoarding boards and vehicle advertising under the Board's standards and charge fees under local law, checking that the site is suitable. Any photo of a person on such advertising must be of a Nepali artist or person. Vehicle ads need a permit from the local government where the vehicle's committee or company is based or the owner lives, and may not cover all the windows or change the vehicle's form. Empty hoardings must carry public-interest notices, and at least 10 percent of digital-board content must be public-interest. Nepal Law Commission Rules 9क-9घ and 10, PDF pp. 8-9
- Advertising agencies must be listed with the Board, paying Rs 5,000 and submitting their registration, tax clearance and turnover and capital details. Listing must be renewed by the end of Poush each fiscal year for Rs 1,000, or the agency is removed automatically. Agencies must keep a register of ads they place, which the Board may inspect. The Board may bar an advertiser, outlet or agency that breaks the code of conduct for a set period and publish its name; no advertiser may then deal with it. Nepal Law Commission Rules 11(1)-(5), 11ख(1)-(3) and 12(1)-(3), PDF pp. 10-12
- Anyone may complain about an advertisement in writing or electronically to the Board, a monitoring and regulation committee or the local government, which must register it and investigate, including by questioning people, requiring documents and inspecting sites. Plainly baseless or harassing complaints may be shelved. The complainant must be told of the decision or action within seven days. The Board also regulates advertising on digital media and social networks, checking whether ads go through official channels and listed outlets or agencies. Nepal Law Commission Rules 9(1)-(6) and 10क, PDF pp. 7-8, 10
