What does it do?

  • These Rules put the Consumer Protection Act, 2075 into practice and replaced the Consumer Protection Rules, 2056. Every seller must display a clear price list, including taxes and other charges, at the place of sale. A separate list is not needed where the price is printed on each pack or container, shown continuously on an electronic display, given per unit on multi-item packs, or set out in a price list or menu. Nepal Law Commission Rule 13(1)-(2), PDF pp. 3-4; Rule 38(1), PDF p. 16
  • Any consumer can complain about a seller or service provider. The complaint (in the Schedule 9 format, though a complaint is not rejected only for using a different format) names the business, describes the defect or harm, gives the complainant's contact details and any evidence. It may be sent by fax, email or telephone, or made orally at the Department of Commerce, Supply and Consumer Protection, and the complainant may ask for their name to be kept confidential. The Department or the inspection officer must register it straight away and give a receipt, and the Director General must order an investigation at once. The Department may also treat news or social-media reports as complaints. Nepal Law Commission Rules 29(1)-(4), 30(1)-(5), 31(1)-(5), PDF pp. 12-14
  • Inspection officers of the Department carry out market inspections. When the Department learns of a breach, the Director General can order a surprise inspection, and the officer must report within 24 hours. Samples sent to a laboratory must be sealed in the prescribed way and signed by the trader and the officer; goods found substandard (or not taken back) are destroyed under a written record, in a way that does not harm public health or the environment. Nepal Law Commission Rule 20(1)-(2), PDF p. 7; Rules 27(1)-(3) and 28(1)-(3), PDF pp. 11-12
  • On-the-spot fines under Section 39 of the Act are imposed by the inspection officer through a written order (Schedule 10) handed to the person fined, with a receipt. The officer sets the amount according to the nature and size of the offence and its effect on consumers, and must state the amount, the bank and account where it is to be paid, and the last date for payment; a register of these fines is kept in the Schedule 11 format. Nepal Law Commission Rule 32(1)-(5), PDF p. 14
  • To keep essential goods affordable, the Ministry may arrange fair-price shops or public distribution centres with public enterprises or the private sector; provincial and local governments may do the same with local traders, with priority to local women's groups or agricultural cooperatives, and the government may sell essential food at subsidised prices through state-owned bodies at festival time. Nepal Law Commission Rule 34(1)-(4), PDF p. 15

Gaps, loopholes and improvement ideas

  • Not enforced On-the-spot fines are not being collected. Rule 32 requires each fine order to state where and by when the fine must be paid. The Auditor General reports that in FY 2081/82 the Department of Commerce, Supply and Consumer Protection fined 76 firms a total of Rs 8.306 million under Section 39 of the Act, but none of that amount had been recovered, and says the arrears should be collected. (The report cites Section 39 of the Act, not Rule 32 by number.) Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd Annual Report, Ministry of Industry, Commerce and Supplies chapter (Department of Commerce, Supply and Consumer Protection), para 31, printed p. 190 (PDF p. 222); Rule 32(3), PDF p. 14

Ideas to fix it

  • Recover the outstanding consumer-protection fines, and make market monitoring more effective. In FY 2081/82 the Department sent 1,320 monitoring teams to 3,900 firms and fined 467 times, totalling Rs 27.696 million. Proposed by: Office of the Auditor General Office of the Auditor General, Nepal
