Rescue and Assistance Fund Operating Regulations for People Affected by Tuin Accident, 2075

What does it do?

• A fund rescues, gives relief to and supports the livelihoods of people hurt by tuin accidents. A tuin is a public cable crossing that carries people, animals or goods over a river in a basket or box on a pulley. Affected people include the injured or disabled and the minor children and dependants of those killed or disabled. The Fund pays for rescue, treatment, skills training and relief for children performing parents' funeral rites, with children given priority.तुइन दुर्घटनाबाट प्रभावित व्यक्तिको उद्धार, राहत र जीविकोपार्जनमा सहयोग गर्न एउटा कोष स्थापना गरिएको छ। तुइन भन्नाले नदी वा खोला तर्न लठ्ठा वा डोरीमा टोकरी वा बाकस र घिर्नी प्रयोग गरी मानिस, जनावर वा सामान ओसारपसार गर्ने सार्वजनिक माध्यम बुझिन्छ। घाइते वा अङ्गभङ्ग भएका व्यक्ति र मृत्यु वा अङ्गभङ्ग भएकाका नाबालक सन्तान र आश्रित परिवार प्रभावित व्यक्तिमा पर्छन्। कोषबाट उद्धार र उपचार, सीपमूलक तालीम र बाबुआमाको काजकिरिया गर्नुपर्ने बालबालिकालाई राहत दिइन्छ र बालबालिकालाई विशेष प्राथमिकता दिइन्छ। Nepal Law Commission Rules 2(ग)-(घ), 3 and 4, PDF pp. 1-2
• Police and the local disaster management committee must do immediate rescue. An affected person applies, with a local level recommendation, to a district committee chaired by the Chief District Officer. It gets a police report, checks the facts and must recommend within fifteen days to the central committee chaired by the Secretary of the Ministry of Federal Affairs and General Administration, which may pay rescue and treatment costs as immediate relief and arrange skills training.तत्काल उद्धार सम्बन्धित प्रहरी कार्यालय र स्थानीय विपद् व्यवस्थापन समितिले गर्नुपर्छ। प्रभावित व्यक्तिले स्थानीय तहको सिफारिससहित प्रमुख जिल्ला अधिकारीको अध्यक्षतामा रहने जिल्ला समितिमा निवेदन दिनुपर्छ। जिल्ला समितिले प्रहरीको प्रतिवेदन लिई जाँचबुझ गरी पन्ध्र दिनभित्र सङ्घीय मामिला तथा सामान्य प्रशासन मन्त्रालयका सचिवको अध्यक्षतामा रहने कोष परिचालन समितिमा सिफारिस गर्नुपर्छ। उक्त समितिले उद्धार र उपचार खर्च तत्काल राहतका रूपमा दिन र सीपमूलक तालीमको व्यवस्था गर्न सक्छ। Nepal Law Commission Rules 5, 7 and 8, PDF pp. 2-4
• Once the regulation started, no person, organisation or body may build any kind of tuin. Local levels must remove all private and public tuins that were operating at that time within at most two years. Whoever builds a tuin against this rule is liable for damage caused by an accident on it.यो नियमावली प्रारम्भ भएपछि कुनै पनि व्यक्ति, संस्था वा निकायले कुनै प्रकारको तुइन निर्माण गर्न पाउँदैन। प्रारम्भ हुँदा सञ्चालनमा रहेका निजी वा सार्वजनिक तुइन स्थानीय तहले बढीमा दुई वर्षभित्र विस्थापन गरिसक्नुपर्छ। यस विपरीत तुइन बनाउने व्यक्ति, संस्था वा निकाय त्यसबाट हुने दुर्घटनाको क्षतिका लागि जिम्मेवार हुन्छ। Nepal Law Commission Rule 9, PDF p. 4
• The Ministry monitors whether Fund money is used for its purpose and refers misuse for legal action. The committee must send an annual report to the Ministry and the Office of the Prime Minister and Council of Ministers by the end of Saun each year. The regulation says the Fund becomes inactive two years after the regulation starts, or earlier once tuins are removed, and any money left goes to the Federal Consolidated Fund.कोषको रकम सही प्रयोजनमा खर्च भए नभएको अनुगमन मन्त्रालयले गर्छ र दुरुपयोग भेटिए कारबाहीका लागि लेखी पठाउँछ। समितिले हरेक वर्ष साउन मसान्तभित्र मन्त्रालय र प्रधानमन्त्री तथा मन्त्रिपरिषद्को कार्यालयमा वार्षिक प्रतिवेदन पेस गर्नुपर्छ। नियमावली प्रारम्भ भएको दुई वर्षपछि वा त्यसअघि तुइन विस्थापन भए त्यसपछि कोष निष्क्रिय हुने र बाँकी रकम सङ्घीय सञ्चित कोषमा दाखिला गर्नुपर्ने व्यवस्था नियमावलीमा छ। Nepal Law Commission Rules 10, 12 and 14, PDF pp. 4-5
