Human Rights Award Fund Operating Regulations, 2075

What does it do?

• The regulation sets up a Human Rights Award Endowment Fund so that the Ministry of Law, Justice and Parliamentary Affairs can give a human rights award, once every two years on International Human Rights Day, to a person or organisation that has made a notable contribution to protecting and promoting human rights. The money is kept in a fixed deposit at a class "A" commercial bank, and only the interest may be spent, and only on the award. • The Fund can receive money from the Government, Nepali individuals and organisations, foreign individuals, governments and international bodies, and other sources. Money from foreign or international sources needs prior approval from the Ministry of Finance. • Before names are recommended, the committee must publicly invite nominations through notices in at least two national daily newspapers and on the Ministry's website. A sub-committee of up to five members, including experts, recommends at most three names on objective grounds, stating each nominee's contribution. Nominees must not be discriminated against on grounds such as age, religion, sex, caste, gender identity or political belief.नाम सिफारिस गर्नुअघि समितिले कम्तीमा दुईवटा राष्ट्रियस्तरका दैनिक पत्रिका र मन्त्रालयको वेबसाइटमा सूचना प्रकाशन गरी योग्य व्यक्ति वा संस्थाको नाम सार्वजनिक रूपमा माग्नुपर्छ। विज्ञसमेत रहेको बढीमा पाँच सदस्यीय उपसमितिले योगदान खुलाई वस्तुनिष्ठ आधारमा बढीमा तीनजना व्यक्ति वा संस्थाको नाम सिफारिस गर्नुपर्छ। उमेर, धर्म, लिङ्ग, जात, लैङ्गिकता, राजनीतिक वा वैचारिक आस्था जस्ता आधारमा भेदभाव गर्न हुँदैन। Nepal Law Commission Rules 8(1), 9(1)-(2) and 10(3)-(4), PDF pp. 4-5
• A person or organisation may not be recommended if convicted of a criminal offence violating human rights, declared bankrupt or blacklisted, punished or made to pay compensation for child, domestic or gender-based violence, or penalised for not paying tax. • The Ministry decides the fields, winners, number of awards and amount on the committee's recommendation, taking account of money in the Fund. It announces the winners on International Human Rights Day (10 December) and must hand over the award with a certificate within seven days. The Fund's final audit is by the Auditor General. Money in the earlier endowment fund set up by a Cabinet decision of 2055 Mangsir 21 moves into this Fund.समितिको सिफारिसमा कोषमा रहेको रकमसमेत विचार गरी मन्त्रालयले पुरस्कारको क्षेत्र, पुरस्कार पाउने व्यक्ति वा संस्था, सङ्ख्या र राशि निर्धारण गर्छ। अन्तर्राष्ट्रिय मानव अधिकार दिवस (डिसेम्बर १०) मा नाम घोषणा गरी घोषणा भएको सात दिनभित्र प्रमाणपत्रसहित पुरस्कार दिनुपर्छ। कोषको अन्तिम लेखापरीक्षण महालेखापरीक्षकबाट हुन्छ। संवत् २०५५ मंसिर २१ गतेको मन्त्रिपरिषद् निर्णयबमोजिम स्थापित अक्षय कोषको सबै रकम यस कोषमा सर्छ। Nepal Law Commission Rules 12(1)-(2), 13(1)-(2), 14(3) and 15, PDF p. 6
