What does it do?

  • The National Criminal Procedure Rules, 2075 (मुलुकी फौजदारी कार्यविधि नियमावली, २०७५) were made by the Supreme Court under Section 196 of the National Criminal Procedure (Code) Act, 2074 and came into force on 1 Bhadra 2075. They set the court-side procedure for criminal cases: arrest warrants and detention, charge sheets, summons and hearings, evidence and witnesses, judgments, appeals and the execution of sentences. Nepal Law Commission Preamble and Rule 1(1)-(2), PDF p. 1; chapter headings, PDF pp. 1-39
  • Police or other investigators must ask a court for permission before issuing an arrest warrant, giving the person's details, a short account of the offence, the evidence linking them to it, and the grounds for arrest; the court may ask for more and grants permission in a set form. An emergency arrest made without prior permission must be put before the court for approval with the arrested person and the papers. Details of a warrant are not made public until the person is arrested. Nepal Law Commission Rule 3(1)-(8) and Rule 5(1)-(3), PDF pp. 1-3
  • To keep a suspect in custody for investigation, the investigator must apply to the court through the government attorney. Before allowing it, the court checks whether the suspect's identity is recorded, whether they were treated properly, given an arrest warrant and told the reason, had a health check and could consult a lawyer, and must tell the suspect their rights. The court must order treatment for a sick detainee, special care for pregnant or new mothers, children, the elderly or disabled, and a hospital examination if it learns that a detainee has been beaten or tortured. Nepal Law Commission Rule 6(1)-(3), Rule 7(1)-(7), Rule 8(1)-(3), PDF pp. 3-4
  • Victims and witnesses whose safety is at risk can ask the court for protection; the court may order safe transport to and from court, a stay in a shelter, security for the person and home, and legal action against anyone threatening them. In cases heard in closed court, copies of papers go only to the parties, the victim and their lawyers, and the victim's identity may not be published. Nepal Law Commission Rule 61, PDF p. 25; Rule 63(1)-(2), PDF p. 25

Gaps, loopholes and improvement ideas

  • Not enforced Most fines and prison terms set by criminal judgments remain unenforced. The judiciary's strategic plan aims to collect each year at least as much as is newly imposed. The Auditor General reports that district courts held Rs 46.55 billion in outstanding penalties and fines in FY 2081/82, of which Rs 14.67 billion (31.51%) was collected, leaving Rs 31.88 billion; arrears of imprisonment stood at 121,103 years, 11 months and 10 days. The year before, only 27.83% of Rs 44.50 billion was collected and 114,637 years, 4 months and 10 days of imprisonment were outstanding. (The report does not cite these Rules by number; Chapter 8 of these Rules sets the court procedure for recording and executing these amounts.) Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd Annual Report, Supreme Court chapter, para 7, printed p. 60 (PDF p. 92); OAG 62nd Annual Report, Supreme Court chapter, para 6, printed p. 57 (PDF p. 87)
