Staff Adjustment Regulations, 2074

What does it do?

• An Organisation and Management Survey Committee does the work set out in Section 4 of the Staff Adjustment Act. It is chaired by the Secretary of the Ministry (General Administration), with joint secretaries from the Office of the Prime Minister and Council of Ministers, the Ministry of Finance, the Ministry of Law, Justice and Parliamentary Affairs and the ministry concerned. • Based on the lists of powers in the Constitution, the Allocation of Business Rules and approved work details, the committee surveys and recommends to the government the structure and staff positions of federal and provincial ministries, federal bodies, and provincial and local offices. It also recommends the services, groups, classes and levels, and the qualifications and other criteria for moving staff between class-based and level-based posts. • The committee may submit separate or combined reports for the federal, provincial or local level, and an interim report where a structure is urgently needed. The government may then approve the structure and positions. The Ministry must register approved civil service positions with the Department of Civil Service Records and send the details to the body running the service (federal) or to the province or local level. • Until staff are adjusted into the approved provincial and local structures, the government deputes civil servants there under Section 11 of the Act, on the basis set by Section 5. Their post stays in the pool of the body running their service, and they keep the pay and benefits they are entitled to by law. Deputed staff must report to their assigned office; anyone who does not report within the time set faces departmental punishment under the law.प्रदेश र स्थानीय तहको स्वीकृत संरचना र दरबन्दीमा समायोजन नभएसम्म नेपाल सरकारले ऐनको दफा ५ को आधारमा दफा ११ बमोजिम सरकारी कर्मचारीलाई कामकाजमा खटाउँछ। यसरी खटिएका कर्मचारीको पदाधिकार सेवा सञ्चालन गर्ने निकायको पुल दरबन्दीमा रहन्छ र उनीहरूले कानून बमोजिमको पारिश्रमिक र सुविधा पाउँछन्। खटिएका कर्मचारी तोकिएको कार्यालयमा हाजिर हुन जानुपर्छ; तोकिएको समयभित्र हाजिर नहुने कर्मचारीलाई कानून बमोजिम विभागीय सजाय हुन्छ। Nepal Law Commission Rules 8(1)-(4) and 9(1)-(2), PDF pp. 4-5
• The head of the receiving office must take the deputed employee's attendance, assign duties, and inform the Ministry, the body running the service and the Department of Civil Service Records. The Coordination Committee formed under Section 8 of the Act must keep updated records of all government staff, coordinate the work, and monitor and direct adjustment and deputation. The Ministry of Finance provides the committees' budget.खटिएको कर्मचारीलाई हाजिर गराई जिम्मेवारी दिनु सम्बन्धित कार्यालयको प्रशासकीय प्रमुखको कर्तव्य हो र हाजिर भएको जानकारी मन्त्रालय, सेवा सञ्चालन गर्ने निकाय र निजामती किताबखानालाई दिनुपर्छ। ऐनको दफा ८ बमोजिमको समन्वय समितिले सबै सरकारी कर्मचारीको अद्यावधिक अभिलेख तयार गराउने, समन्वय गर्ने र समायोजन तथा कर्मचारी खटाउने कामको अनुगमन र निर्देशन गर्छ। समितिहरूलाई चाहिने बजेट अर्थ मन्त्रालयले व्यवस्था गर्छ। Nepal Law Commission Rules 9(3)-(4), 10(1) and 12, PDF pp. 5-6
