Political Party Regulation, 2074

What does it do?

• To register a party, its chief office-bearer applies to the Election Commission on the Schedule-2 form, following a central committee decision, with the papers listed in Section 5(1) of the Act and a commitment and declaration signed by at least 500 Nepali voters. The Commission may check the signatures against the voter roll and call office-bearers in to confirm their signatures, giving up to seven days to fix gaps. • If at least 40% of the central committee and of the federal parliamentary party of a party represented in the Federal Parliament form a new party under Section 33(2) of the Act, they apply on the Schedule-5 form with the new party's constitution, flag and logo, a signed support letter and a central committee of at least 21 members. The Commission registers it within 45 days if the conditions are met. • A party that takes more than Rs 1 lakh from a Nepali citizen or organisation must record the donor's name, address, occupation and PAN, the source of the money and whether it is taxable. The Commission may investigate a complaint with evidence that a party took a banned donation. A party's audit report must show its fixed and current assets, income (membership fees, donations, other), spending (elections, administration, staff, other) and bank balances. • Before each election the Commission must publish, on its website and in national media, a period for parties to register for that election. A registered party that wants to take part applies on the Schedule-12 form with its constitution, manifesto and the previous fiscal year's audit report, plus any earlier audit reports it has not yet filed. • If the Commission learns that a party has done something listed in Section 12(3) of the Act, it may investigate and must give the party 15 days to respond. If the party does not respond or its answer is unsatisfactory, the Commission decides within 15 days to cancel its registration, and the cancellation is published in the Nepal Gazette.
