Military Prada Service Regulation, 2074

What does it do?

• The Regulation sets up the Military Prada (legal) Service, the Nepali Army's service of officers and junior officers who do legal and justice work, headed by the Sena Prada Bibak. Its posts run from Jamadar and Subedar up to Upa-Rathi (major general). Jamadar posts are filled entirely by open competition; Upasenani posts 90 percent by open competition and 10 percent by internal competition among Subedars with ten years' service; higher posts by promotion.यस नियमावलीले नेपाली सेनामा कानून तथा न्यायसम्बन्धी काम गर्ने प्राड अधिकृत र प्राड पदिक रहने सैनिक प्राड सेवा खडा गरेको छ, जसको प्रमुख सेना प्राड विवाक हुन्छन्। यस सेवामा जमदार र सुबेदारदेखि उपरथीसम्मका पद रहन्छन्। जमदार पद शत प्रतिशत खुला प्रतियोगिताबाट, उपसेनानी पद ९० प्रतिशत खुला र १० प्रतिशत दश वर्ष सेवा पूरा गरेका सुबेदारबीचको आन्तरिक प्रतियोगिताबाट तथा माथिल्ला पद बढुवाबाट पूर्ति हुन्छन्। Nepal Law Commission Rules 2(g)-(h), 4 and 5(1)-(2), PDF pp. 1-3
• A Jamadar applicant needs a 10+2 qualification. An Upasenani applicant in open competition needs a law degree and an advocate's licence from the Nepal Bar Council. Promotion to Sahasenani, Senani and Pramukh Senani needs a law degree, and to Mahasenani and above a master's in law, though officers already at Pramukh Senani or above when the Regulation started had four years' grace.जमदार पदका उम्मेदवारका लागि कक्षा १२ वा सो सरह उत्तीर्ण हुनुपर्छ। खुला प्रतियोगिताबाट उपसेनानी हुन कानूनमा स्नातक गरी नेपाल कानून व्यवसायी परिषद्बाट अधिवक्ताको प्रमाणपत्र प्राप्त गरेको हुनुपर्छ। सहसेनानी, सेनानी र प्रमुख सेनानीमा बढुवा हुन कानूनमा स्नातक र महासेनानी वा सोभन्दा माथिका पदमा कानूनमा स्नातकोत्तर चाहिन्छ; नियमावली प्रारम्भ हुँदा प्रमुख सेनानी वा माथि रहेका अधिकृतलाई चार वर्षसम्म छुट दिइएको थियो। Nepal Law Commission Rule 16(1)-(2), PDF pp. 9-10
• Forty-five percent of open-competition posts are reserved for women, Adivasi/Janajati, Madhesi, Dalit and people from listed remote districts. Upasenani candidates are selected by a committee chaired by the Public Service Commission chair or a member he or she names, and the Commission runs the written exam. Candidates take physical, written, practical, medical and interview tests, plus officer-quality tests for Upasenani. • The Government promotes Mahasenani to Upa-Rathi, the Chief of the Army Staff promotes Upasenani to Pramukh Senani, and the Sena Prada Bibak promotes to Subedar, each on a promotion committee's recommendation. An officer convicted by a court of financial irregularity or polygamy, or of violating human rights and humanitarian law, cannot be a candidate for promotion.
