Regulations on Reconstruction of Structures Affected by Earthquake, 2016

What does it do?

• The reconstruction Authority must set priorities and carry out projects in this order of grounds: private housing, integrated settlements and extra help to relocate people and settlements at risk; public health institutions; public schools and other educational institutions; archaeological and historical heritage; government buildings; and other public structures and infrastructure it considers necessary. Bodies carrying out reconstruction or integrated settlement projects must follow the quality standards and methods the Authority sets.पुनर्निर्माण प्राधिकरणले निजी आवास पुनर्निर्माण, एकीकृत बस्ती विकास र जोखिममा रहेका व्यक्ति तथा बस्ती स्थानान्तरणमा थप सहयोग; सार्वजनिक स्वास्थ्य संस्था; सार्वजनिक शैक्षिक संस्था; पुरातात्त्विक तथा ऐतिहासिक सम्पदा; सरकारी भवन; र आवश्यक ठानेका अन्य सार्वजनिक संरचना तथा पूर्वाधारका आधारमा पुनर्निर्माणको प्राथमिकता निर्धारण गरी आयोजना कार्यान्वयन गर्नुपर्छ। पुनर्निर्माण वा एकीकृत बस्ती विकास आयोजना चलाउने निकायले प्राधिकरणले तोकेको गुणस्तर, मापदण्ड र विधि पालना गर्नुपर्छ। Nepal Law Commission Rules 3(क)-(च) and 4, PDF pp. 1-2
• A poor person who cannot remove or demolish a damaged or risky structure themselves may apply to the Authority to have it done at government cost. This covers people holding a very-poor identity card from the Government, people without such a card whose annual income is below fifty thousand rupees, and people who cannot afford the technology or equipment needed. The last two groups must attach recommendations from their local level and the district disaster management committee. If the claim is valid, the Authority may have the work done.भूकम्पबाट क्षतिग्रस्त वा जोखिमयुक्त संरचना आफैँ हटाउन वा भत्काउन नसक्ने विपन्न व्यक्तिले सरकारी खर्चमा त्यस्तो संरचना हटाइदिन प्राधिकरणसमक्ष निवेदन दिन सक्छ। यसमा नेपाल सरकारबाट अति गरिबको परिचयपत्र पाएका, त्यस्तो परिचयपत्र नपाएका भए वार्षिक पचास हजार रुपैयाँभन्दा कम आय भएका र आवश्यक प्रविधि वा उपकरणको लागत बेहोर्न असमर्थ व्यक्ति पर्छन्। पछिल्ला दुई समूहका निवेदकले गाउँपालिका वा नगरपालिका तथा जिल्ला विपद् व्यवस्थापन समितिको सिफारिस पेस गर्नुपर्छ। व्यहोरा मनासिब देखिए प्राधिकरणले यो काम गराउन सक्छ। Nepal Law Commission Rule 5(1)-(3), PDF pp. 2-3
• When the Authority asks the Government of Nepal for staff and they are not provided within one month, it may hire staff on contract. A recruitment committee chaired by the Authority's secretary must advertise with at least seven days' notice, select candidates on education and experience using criteria published on the Authority's website, and the Chief Executive Officer appoints those recommended after a contract in the Schedule's format. • Each District Coordination Committee coordinates reconstruction in its district, asks the Authority for more money if the district's allocation falls short, monitors the offices running projects and reports to the Authority, and recommends improvements. The Chief District Officer provides staff for its secretariat.
