What does it do?
- Parties to a case already filed may ask at any time, on the Schedule 5 form, to settle it through mediation. If both agree, the registrar (Supreme Court and High Court), the shrestedar (District Court) or the head of another case-hearing body may order mediation. The order may set up to three months for it, in one go or in instalments. The parties then appoint up to three mediators from the court's list or from people holding a mediator certificate. Nepal Law Commission Rules 12(1)-(3), 15 and 18(1), PDF pp. 5-7
- Before discussing the case, the mediator must explain the process, that the parties themselves reach any agreement, that everything said stays confidential, and that either party may leave at any time. With the parties' consent, mediation may be held by telephone or video. If they agree, the mediator writes up a settlement deed, has it signed and sends the parties to the court, which then prepares the formal settlement (मिलापत्र). If mediation fails or the parties do not turn up, the mediator must report to the court within seven days and the case goes ahead under the law. Nepal Law Commission Rules 23(2), 23(4), 25 and 27, PDF pp. 9-11
