New Nepal Construction Fund (Operation) Regulation, 2068

What does it do?

• The regulation sets up the New Nepal Construction Fund to run programmes and projects as a campaign with wide public participation, for economic growth, jobs, infrastructure and relief. Money can come from the public, non-resident Nepalis, salary donations by public and organised-sector employees, organisations, foreign states, international bodies and the Government. The Fund must get the Ministry of Finance's consent before taking money from foreign states or international bodies.व्यापक जनसहभागितामा आर्थिक वृद्धि, रोजगारी सिर्जना, पूर्वाधार विकास र जनतालाई राहत पुर्‍याउने कार्यक्रम तथा योजना अभियानका रूपमा चलाउन यो नियमावलीले नयाँ नेपाल निर्माण कोष स्थापना गरेको छ। कोषमा आम जनता, गैरआवासीय नेपाली, सार्वजनिक तथा सङ्गठित क्षेत्रका कर्मचारीको तलब वा पारिश्रमिकको अंश दान, विभिन्न सङ्घसंस्था र व्यक्ति, विदेशी राष्ट्र, अन्तर्राष्ट्रिय सङ्घसंस्था र नेपाल सरकारबाट रकम आउन सक्छ। विदेशी राष्ट्र वा अन्तर्राष्ट्रिय संस्थाबाट रकम लिनुअघि कोषले अर्थ मन्त्रालयको सहमति लिनुपर्छ। Nepal Law Commission Rules 3(1)-(3) and 4, PDF p. 2
• A steering committee chaired by the Vice-Chair of the National Planning Commission runs the Fund. Its members are the secretaries of the Prime Minister's Office, Finance, Physical Planning and Works, and Local Development, plus three experts named by the Government for two years; the NPC Secretariat's secretary is member-secretary. • Local bodies, voluntary organisations and community groups may send project proposals to the Fund's secretariat, with objectives, budget, timeline and expected results. A recommendation committee assesses them and the steering committee may approve them; the Fund must then sign an agreement with the proposer. The Fund will not invest in a project without local people's participation. • Bodies running projects must keep accounts under the law, hand in their accounting papers within 35 days of finishing a project, send progress reports every four months and every year, and make public each four months the money received and how it was spent. Funded projects are audited by a chartered accountant; the Fund's final audit is by the Auditor General. • Anyone, Nepali or foreign, may donate to the Fund, and the Fund publishes donors' names every three months and on its website. Donors of Rs 1 million or more receive a letter of appreciation signed by the Prime Minister; donors of Rs 100,000 up to Rs 1 million receive one signed by the chair.
