What does it do?

  • The Authority must prepare its physical development plan treating the whole Kathmandu Valley as one planning unit, and must coordinate with government bodies, local levels and other organisations. Once the Government of Nepal approves the plan, its details must be published in the Nepal Gazette, and the plan takes effect on publication. The Authority may issue building and planning standards with Government approval, and everyone concerned must follow them. Nepal Law Commission Rules 3(1)-(3), 4 and 5(1)-(2), PDF p. 2
  • Landowners or tenants may apply for a guided land development programme in an area with clear boundaries; the Authority may run it if at least fifty families can settle there, and any compensation for land that has to be acquired is paid entirely by the local people who benefit. For land pooling, the Authority may act on its own or on an application by at least 51 per cent of the landowners or tenants, again where at least fifty families can live, and may ban subdividing or physically changing property there for up to two years. Nepal Law Commission Rules 8(2)-(3) and 9(1)-(3), PDF pp. 3-4
  • In land pooling, the Authority sets aside land for roads, drains, open space, water, electricity and other services after consulting the users' committee, and may freeze transfers of property in the project for up to one year while plots are merged. It then returns developed plots to the former owners or tenants, and the survey and land revenue offices must update the maps and issue new ownership certificates; old records are cancelled automatically. An owner of land below the minimum plot size who cannot pay the set cost may instead be paid the prevailing price. Nepal Law Commission Rules 10-13, PDF pp. 4-5
  • After a land development project is complete, the Authority may hand it over to the local level or to a registered users' committee, but only if at least 60 per cent of the landowners or tenants who directly benefit are members of that committee. The handover is made by agreement, and if the project is not maintained as agreed the Authority may take it back at any time. A local level may also run its own land development programme with the Authority's approval, following the same procedures. Nepal Law Commission Rules 14(1)-(5) and 15(1)-(3), PDF pp. 5-6
  • Appeals go to an appeal committee whose members must be either law graduates with at least ten years' experience in the field, or engineers who have served at least five years in a gazetted first-class post in the civil (building and architecture) group. Members serve three years. The committee should normally decide an appeal within three months; if its members still cannot reach a majority, the matter goes to the Supreme Court, whose decision is final. Nepal Law Commission Rules 18(1)-(2) and 19(4)-(6), PDF pp. 7-8
