What does it do?
- The Election Commission compiles and updates the voter list ward by ward. It publishes a programme for this in the Nepal Gazette and may name the District Election Officer as chief registration officer for each district. It appoints assistant registration officers for wards, whose office is in the ward office. Government staff, local-body staff and community school teachers can be sent out as data collectors.निर्वाचन आयोगले वडागत रूपमा मतदाता नामावली सङ्कलन तथा अद्यावधिक गर्छ। यसका लागि आयोगले कार्यक्रम नेपाल राजपत्रमा प्रकाशन गर्छ र प्रत्येक जिल्लामा जिल्ला निर्वाचन अधिकारीलाई प्रमुख नाम दर्ता अधिकारी तोक्न सक्छ। वडामा सहायक नाम दर्ता अधिकारी नियुक्त हुन्छन्, जसको कार्यालय वडा कार्यालयमा रहन्छ। नेपाल सरकार, स्थानीय निकायका कर्मचारी वा सामुदायिक विद्यालयका शिक्षकलाई सङ्कलकका रूपमा खटाउन सकिन्छ। Nepal Law Commission Rules 3, 4, 6 and 7, PDF pp. 2-4
- Every Nepali citizen has a duty to come to the place and at the time set in the programme and give the details needed to register. Collectors record the details on the Schedule 5 form, and registration staff take the person's fingerprints and photo and enter everything into the computer. Anyone qualified who was left off the published list can apply in person to the assistant registration officer to be added.कार्यक्रममा तोकिएको समय र स्थानमा उपस्थित भई आवश्यक विवरण दिएर मतदाता नामावलीमा नाम दर्ता गराउनु प्रत्येक नेपाली नागरिकको कर्तव्य हो। सङ्कलकले अनुसूची–५ को ढाँचामा विवरण सङ्कलन गर्छन् र दर्ता कर्मचारीले औँठाछाप र फोटो लिई विवरण कम्प्युटरमा प्रविष्ट गर्छन्। प्रकाशित नामावलीमा नाम छुटेको योग्य व्यक्तिले सहायक नाम दर्ता अधिकारीसमक्ष आफैँ उपस्थित भई नाम समावेश गर्न निवेदन दिन सक्छ। Nepal Law Commission Rules 10, 14 and 17, PDF pp. 5-9
- Voters or their family members can ask, within the period in the programme, to correct a name, surname, date of birth or age, attaching proof such as birth, marriage or migration registration. They can also ask to remove or move the name of a voter who has died, moved away permanently, married elsewhere or given up citizenship. Any voter of the same ward can object to a name that should not be on the list. The officer must publish a notice and give the person a chance to respond before removing it. Duplicate entries are removed after checking the name, parents' names, citizenship certificate, photo and fingerprints. - When claims and objections are settled, the chief registration officer prepares the final voter list for each ward, signs every page and publishes it, then sends a certified copy to the Commission. The Commission checks for duplicates before making copies. Disputes are settled on the basis of the certified list. The Commission may put the final list on its website. Voters and candidates can look at the list, and copying it out by hand is free. The Commission may also sell copies at a price it sets. - The Election Commission made this regulation under Section 44 of the Electoral Roll Act, 2063, and it replaced the Electoral Roll Regulation, 2063. That Act has since been repealed by the Voter Roll Act, 2073 (Section 46), which treats anything done under the old Act as done under the new one. Gaps, loopholes and improvement ideas
- Not enforced Names of voters who have died or moved are not being removed. Rule 19 lets voters or family members apply to remove or transfer such names. The Auditor General found in two successive reports that new voters keep being added, but the names of voters who died, moved, or married and left had not been updated. - Capacity Duplicate entries are hard to clean up. The Election Commission's 2081/82 annual report says one voter can be entered from more than one district. Because the photos and fingerprints in the list are of poor quality, its automated fingerprint system (AFIS) cannot remove duplicates, so this is done by hand, with a risk of human error. Moving data from election offices to the central server by hand can lose records or remove the wrong voter, and logs of deaths removed are not kept properly. Ideas to fix it
- Make voter-list updating automatic by linking it with the software the government uses for vital-event registration and national identity cards. - Let a voter's family members register at the address where the voter actually lives, if that voter is already registered there instead of at their permanent address, and draw up a procedure for registering and updating voters through local governments. The Election Commission's Fourth Strategic Plan (2081/82-2085/86) set this for 2081/82.
