What does it do?

  • On the committee's recommendation, the Ministry sorts freed kamaiyas into four classes for resettlement, jobs and income work: class "ka" has no house or land in their own or their family's name; "kha" lives on public or government land and owns no land; "ga" has a house and up to two kattha of land; "gha" has a house and more than two kattha. The welfare officer must give each freed kamaiya an identity card: red for ka, blue for kha, yellow for ga and white for gha. Nepal Law Commission Rules 3 and 4(1)-(2), PDF pp. 1-2
  • The Government gives families in classes ka and kha up to five kattha of land for housing and farming, chosen from land the committee recommends, and where possible the land they already use. Limits are one kattha in municipalities and market areas next to highways, two kattha in other highway areas and five kattha elsewhere. People who took a loan under this regulation to buy land do not get land. Class ka families, and class kha families without a house or who were moved, also get a one-time sum and timber to build a house. Nepal Law Commission Rules 5(3), 6(1)-(4), 7 and 11, PDF pp. 2-5
  • The land ownership certificate must state that the land cannot be mortgaged or transferred. It may still be divided among legal co-heirs and passed to heirs after death. If the Government acquires the land, it must first make sure the family gets other land in exchange. The land is taken back into the Government's name if it was obtained with false information, or if the family does not live on it or does not use it for three years or more in a row. Nepal Law Commission Rules 8(2), 9(1)-(4) and 10(1), PDF pp. 3-4
  • At least 25 freed kamaiya families may form a group to run a business together. They apply to the welfare officer in the Schedule-1 form with a Rs 50 fee and receive a certificate. The certificate lasts until the end of the fiscal year and must be renewed at least 15 days before it ends for Rs 25, or within three months after it ends with an extra Rs 100. Groups must report on their work to the welfare officer every three months. Nepal Law Commission Rules 14(1)-(3), 15(1)-(4) and 21(1), PDF pp. 6-8
  • The Government may lend class ka and kha families who got no land a one-time loan to buy up to two kattha for housing, and may lend freed kamaiyas or groups money for income-earning businesses or for air tickets to go abroad for work. Interest may not be more than 3 percent a year. Loans up to Rs 50,000 are approved by the welfare officer, those over Rs 50,000 up to Rs 100,000 by a sub-committee, and larger ones by the Ministry's secretary. Borrowers sign a bond and must use the money only for the stated purpose, or it can be recovered at any time. Nepal Law Commission Rules 17(1)-(6), 18(2)-(4), 19 and 20, PDF pp. 7-8
