Special Group Employee Administration and Management Regulation, 2065

What does it do?

• The regulation creates a Special Group within the Miscellaneous Service of the civil service for staff of the former Royal Palace Service. Those in post when it took effect (treated as from Shrawan 1, 2064) keep their class and post in the group. Anyone appointed after Jestha 4, 2063 does not join the group. The Ministry of General Administration manages the group through a special-class officer named as its secretary.यस नियमावलीले निजामती सेवाको विविध सेवाअन्तर्गत विशेष समूह कायम गरी तत्कालीन राजप्रासाद सेवाका कर्मचारीलाई त्यसमा राखेको छ। नियमावली प्रारम्भ हुँदा (संवत् २०६४ साउन १ देखि लागू भएको मानिने) बहाल रहेका कर्मचारी आफ्नै श्रेणी र पदमा समूहमा कायम हुन्छन्। संवत् २०६३ जेठ ४ पछि नियुक्त व्यक्ति समूहमा रहँदैनन्। समूहको प्रशासन र व्यवस्थापन सामान्य प्रशासन मन्त्रालयले विशिष्ट श्रेणीका अधिकृतलाई सचिव तोकी गर्छ। Nepal Law Commission Rules 1(2), 3, 4(1)-(2) and 5(1)-(3), PDF pp. 1-4
• Within 45 days of the regulation's publication, each employee had to submit three copies of a record form (Schedule 1) with an oath form (Schedule 2). The secretary certifies the forms within 15 days and sends copies to the Office of the Prime Minister and Council of Ministers and the Ministry. Salary and benefits are given only to employees whose forms arrive on time. • Posts in the group are abolished automatically when they fall vacant, and the Ministry must be told within seven days. As an exception for promotion, the group keeps 3 first-class, 9 second-class and 21 third-class gazetted posts and 34 first-class non-gazetted posts. When one falls vacant, the Ministry must write to the Public Service Commission within a month, and promotion is by performance evaluation on the promotion committee's recommendation.समूहको पद जुनसुकै कारणले रिक्त भएमा स्वतः खारेज हुन्छ र सात दिनभित्र मन्त्रालयलाई जानकारी दिनुपर्छ। बढुवाका लागि भने राजपत्राङ्कित प्रथम श्रेणीमा तीन, द्वितीय श्रेणीमा नौ, तृतीय श्रेणीमा एक्काइस र राजपत्र अनङ्कित प्रथम श्रेणीमा चौँतीस पद कायम रहन्छन्। यस्ता पद रिक्त भएको एक महिनाभित्र मन्त्रालयले लोक सेवा आयोगमा लेखी पठाउनुपर्छ र बढुवा समितिको सिफारिसमा कार्यक्षमताको मूल्याङ्कनद्वारा बढुवा गरिन्छ। Nepal Law Commission Rules 11(1), (3) and 11क(1)-(4), PDF pp. 6-7
• The First Amendment moved staff into standard civil-service posts, from joint secretary down to mukhiya. Lower-grade staff holding the 94 post titles in Schedule 3 could ask within 60 days to be placed in classless posts instead. Staff moved to a lower pay scale keep their previous pay. Officials of special class or above serve a five-year term.
