Peace Fund (Operation) Regulation, 2065

What does it do?

• The regulation sets up a Peace Fund to support the peace process: resettling displaced people and families affected by the conflict, implementing the peace agreements, transitional justice projects agreed with donors, mine-risk awareness and peace and security work. It may not fund the internal running of the Truth and Reconciliation Commission or the Commission of Investigation on Enforced Disappeared Persons. • A Fund Board chaired by the Minister for Peace and Reconstruction, with the Finance Minister as co-chair, runs the fund. It includes one member each from the five largest parties in the Constituent Assembly, the Vice-Chair of the National Planning Commission and the Home and Finance secretaries. It must meet at least once every six months. • A government body, registered NGO, community organisation or approved international organisation that wants to run a project first submits a concept note to the Fund secretariat. If a working group approves the concept, it submits a full proposal, which a sectoral working group assesses for technical, economic, social, gender and environmental impact. The Technical Committee approves projects of up to Rs 100 million (ten crore) itself and sends larger ones to the Board. • The secretariat may advance up to two four-monthly instalments, and pays the rest only after the implementing body reports and shows it has spent at least 80 percent of the advance. Implementing bodies must report progress monthly, every four months and yearly, submit certified annual accounts within one month of the fiscal year's end and the audit report within six months, and send quarterly procurement and audit-settlement plans. The secretariat must publish what the fund received and spent every four months. • The fund was set up for three years from its establishment. The Government of Nepal could extend it, but not beyond the end of Asar 2075.
