National Vigilance Center (Operation) Regulation, 2065

What does it do?

• Anyone who learns of an irregularity, or one about to happen, in a government office or public body may complain to the National Vigilance Centre, with or without giving their name. A complaint can be made by post, telephone or other electronic means, or in person, in writing or orally; the Centre must write down and certify phone and oral complaints. A named complainant who asks must be told what action was taken. The Centre should normally finish handling a complaint or report within six months.सरकारी कार्यालय वा सार्वजनिक संस्थाको काममा अनियमितता भएको वा हुन लागेको थाहा पाउने जोसुकैले आफ्नो नाम खुलाई वा नखुलाई राष्ट्रिय सतर्कता केन्द्रमा उजुरी दिन सक्छ। उजुरी हुलाक, टेलिफोन वा अन्य विद्युतीय माध्यमबाट वा आफैँ उपस्थित भई लिखित वा मौखिक रूपमा दिन सकिन्छ; टेलिफोन वा मौखिक उजुरी केन्द्रले लेखबद्ध गरी प्रमाणित गरेर राख्नुपर्छ। नाम खुलाउने उजुरीकर्ताले माग गरेमा भएको कारबाहीको जानकारी दिनुपर्छ। केन्द्रले सामान्यतया छ महिनाभित्र उजुरी वा सूचनाको टुङ्गो लगाइसक्नुपर्छ। Nepal Law Commission Rules 4(1)-(3), 6 and 29, PDF pp. 2-3, 14
• The Centre regularly monitors government offices and public bodies on their work, the services they must give the public, delays and irregularities, and how anti-corruption strategies are carried out. It may give suggestions or directions, warn the office head and staff in writing, and ask the relevant authority to take action. If warned officials still do not improve, the Centre must refer them for departmental action, and to the Commission for the Investigation of Abuse of Authority (CIAA) where other legal action is needed. • Every government office and public body must make its public office-holders submit property statements within the time set by Section 50 of the Prevention of Corruption Act. Within one month after that deadline, it must send its ministry or central body a list of who did and did not submit, and the ministry must forward the statements to the Centre within one month. • The Centre carries out technical audits of public infrastructure projects, checking design, cost, quality, timing, procurement and whether the project meets its aims. Technical auditors are chosen from a list of engineers with at least a bachelor's degree, at least 10 years' experience and registration with the Nepal Engineering Council, and must be trained. Auditors may inspect sites, labs and machinery and call project chiefs for questioning. • Offices and officials must give the Centre's staff and auditors the documents and help they ask for. A project chief who withholds documents, or an office head who ignores the Centre's written requests, can be reported to their appointing authority, which must take departmental action and inform the Centre. Anyone proven to have made a false complaint to harass someone can be referred for action.
