What does it do?

  • This is the code of conduct for civil servants. It was made under the Good Governance (Management and Operation) Act, 2064 (Section 44, for the purposes of Section 23(2)(c)), not under the Civil Service Act. It covers employees serving under the Civil Service Act, 2049 and also health service employees under the Health Service Act, 2053. Every office must tell its staff about these Rules. Nepal Law Commission Preamble and Rule 2(a), PDF p. 1; Rule 30, PDF p. 10
  • Civil servants must act impartially and free of undue influence. They must not accept gifts, donations or contributions that affect their duties, or deal with people whose business is before their office. They must not run a business unless the law allows it. If they have a personal interest in a matter handled by their office, they must tell the officer above them. They must stay politically neutral and must not speak for or against any party or leader, or let government property be used for party work. Nepal Law Commission Rules 8-10, PDF p. 4; Rule 12, PDF p. 5; Rule 23(3), PDF p. 8
  • In serving the public, civil servants must give priority to older people, people with disabilities, pregnant women and women who have recently given birth, children and people without support. They must finish service seekers' work on time, or quickly tell them why it cannot be done. They must give information in simple language and fetch records held by other government bodies themselves rather than sending the citizen. Grievances and requests must get a courteous, timely and effective reply, and office heads must make sure this happens. Nepal Law Commission Rule 14(1)-(5), PDF pp. 5-6; Rule 15(1)-(2), PDF p. 6
  • Civil servants must not disclose information the law treats as confidential or use official information for their own or anyone else's benefit. Only the office head, the information officer or the spokesperson may make unpublished office information public or speak to the media about office work. Information given out must be complete and accurate. After retirement, employees remain bound by the rules on dignity of office, information, respect for the profession and reporting harm to public property, and must not reveal unpublished matters learned in service. Nepal Law Commission Rule 7(1)-(6), PDF pp. 3-4; Rule 28(1)-(2), PDF p. 10
  • Each ministry, secretariat, commission and central body must regularly monitor whether its own staff and those of the bodies under it follow these Rules, and must take departmental action under the law against those who do not. Ministries with a special type of work may add their own codes. Civil servants who learn that public property is being harmed, or that an illegal or criminal act is planned or under way, must report it at once. Nepal Law Commission Rule 26(1)-(2), PDF pp. 9-10; Rules 27 and 29, PDF p. 10

Gaps, loopholes and improvement ideas

  • Not enforced The code is not strictly followed and breaches are rarely pursued. Transparency International Nepal's 2023 civil society report on Nepal's implementation of the UN Convention against Corruption names this Regulation (the 2009 code made under Section 44 of the Good Governance Act). It finds that codes of conduct are not strictly followed in practice and that breaches are seldom followed up. Stepping aside where a personal interest is involved is 'not strictly enforced in civil service so far', and Nepal has no law regulating conflicts of interest. These findings concern the duties in Rule 10 (declaring a personal interest) and Rule 29 (monitoring and departmental action). Transparency International Nepal with the UNCAC Coalition · Nepal Law Commission TI Nepal report §4.1.5, printed pp. 40-41 (PDF pp. 43-44) and 'Deficiencies', printed p. 43 (PDF p. 46); Regulation Rules 10 and 29, PDF pp. 4 and 10
  • Not enforced Service seekers report that service duties are not being met. The Auditor General reports a service-recipient satisfaction survey run by the Ministry of Federal Affairs and General Administration in FY 2080/81, covering 16 public offices in eight districts (District Administration, Land Revenue, Survey and Inland Revenue offices) and 330 service seekers. It found that older people and people with disabilities were not given priority, grievances were not properly resolved, and information was hard to get. Some offices could only be dealt with through middlemen, and service was slow, cumbersome, costly and not impartial. The Auditor General judged the state of service delivery unsatisfactory. These are the duties set in Rules 14 and 15. Office of the Auditor General, Nepal · Nepal Law Commission OAG 62nd Annual Report, Ministry of Federal Affairs and General Administration chapter, para 8, printed p. 523 (PDF p. 553); Regulation Rules 14-15, PDF pp. 5-6

Ideas to fix it

  • Draft and implement new laws on managing conflicts of interest and on protecting people who report corruption, witnesses, experts, investigators and victims. Proposed by: Commission for the Investigation of Abuse of Authority Commission for the Investigation of Abuse of Authority
  • Fix the problems the satisfaction survey found by reforming how offices are organised and work, improving staff integrity and capacity, and adopting reliable information technology, so that citizens no longer have grounds to complain about service delivery. Proposed by: Office of the Auditor General Office of the Auditor General, Nepal
