What does it do?

  • The ministry responsible must keep an up-to-date list of infrastructure projects that could be built or run with private investment, on the committee's advice, and send a project to the Government of Nepal for approval with details such as how it will be implemented, whether it is in the plan or annual programme, and why private investment suits it. Once the government approves a project, the ministry must publish a notice in at least two major national newspapers and, if possible, on its website. Nepal Law Commission Rules 3-5, PDF pp. 1-3
  • To choose investors, the ministry first invites letters of interest through a newspaper notice. The document costs Rs 20,000. Applicants are scored out of 100: 40 for technical capacity, 40 for financial capacity and 20 for experience. Those scoring at least 60 are shortlisted; if fewer than two reach 60, those with at least 50 are added. If only one letter arrives or fewer than two are shortlisted, the ministry must invite letters again. Shortlisted applicants must be told in writing within seven days. Nepal Law Commission Rules 7, 8, 10(1)-(3), 11(1) and 12(2), PDF pp. 4-6
  • Shortlisted firms buy the proposal document for Rs 20,000 (study reports are free on request) and submit technical and financial proposals in separate sealed envelopes. Technical proposals are opened first and need at least 60 percent. Financial proposals are compared on the user charges proposed, the royalty or other payment to the government, and the contract period, and the ministry must notify the chosen bidder within seven days. Within 15 days the chosen bidder must deposit 0.1 percent of the estimated project cost, or an equal bank guarantee. Nepal Law Commission Rules 14, 15(1)-(3), 17(1)-(8) and 20(1), PDF pp. 7-11
  • The government may form an Infrastructure Service Fee Review Board, with a secretariat at the National Planning Commission and a four-year term for members, to review the fees charged to users. Where a contract sets only a method for fixing fees, fees are reviewed every five years; they are also reviewed when the contract period or agreed profit rate changes, or on a justified request from the licence holder or the ministry. The Board sends the new rates and their basis to the ministry. The ministry may inspect projects and direct a licence holder that is not complying. Nepal Law Commission Rules 25(1)-(6), 27, 29 and 33, PDF pp. 14-18
  • A footnote to the official text says the parent Act (the Private Investment in Construction and Operation of Infrastructure Act, 2063) was repealed and the Public-Private Partnership and Investment Act, 2075 now applies. Rule 51(1) of the Public-Private Partnership and Investment Regulation, 2077 repealed this Regulation, and work done under it counts as done under the 2077 Regulation. The points above describe this Regulation as it stood before repeal. Nepal Law Commission · Nepal Law Commission Footnote, PDF p. 1; Public-Private Partnership and Investment Regulation, 2077, Rule 51(1)-(2), PDF pp. 43-44
