The Prime Minister's Disaster Relief Fund Operating Regulation, 2063

What does it do?

• The regulation sets up the Prime Minister's Disaster Relief Fund, run as a revolving fund. It receives voluntary contributions from the Prime Minister, ministers, constitutional office-holders, MPs, civil servants, army and police staff, organisations, businesses, political parties, trade unions, civil society and the public, as well as money from donor countries and agencies, the Government of Nepal and other sources. "Disaster" includes floods, landslides, fires, earthquakes, storms, drought, epidemics, road accidents from natural causes and industrial accidents.यो नियमावलीले आवर्ती कोषका रूपमा सञ्चालन हुने प्रधानमन्त्री दैवी प्रकोप सहायता कोष खडा गरेको छ। कोषमा प्रधानमन्त्री, मन्त्री, संवैधानिक पदाधिकारी, सांसद, निजामती, जङ्गी र प्रहरी कर्मचारी, विभिन्न संस्था, व्यवसायी, राजनीतिक दल, ट्रेड युनियन, नागरिक समाज र सर्वसाधारणले स्वेच्छाले दिएको रकम तथा दातृ मुलुक र संस्था, नेपाल सरकार र अन्य स्रोतबाट प्राप्त रकम जम्मा हुन्छ। बाढी, पहिरो, आगलागी, भूकम्प, आँधीबेहरी, अनावृष्टि, महामारी, प्राकृतिक कारणले हुने सडक दुर्घटना र औद्योगिक दुर्घटनालाई दैवी प्रकोप मानिन्छ। Nepal Law Commission Rule 2(ग) and Rule 3(1)-(3), PDF pp. 1-2
• The fund pays for rescue and protecting property, temporary relief camps, food, clothing, medicine and educational materials, treatment of the injured or sick, financial help to relatives of the dead for last rites, disposal of disaster waste, temporary shelter or resettlement, help to repair homes or work tools, and disaster awareness and preparedness. • A Fund Operation Committee runs the fund. It is chaired by the Vice-Chair of the National Planning Commission, with the secretaries of the Ministries of Home Affairs, Local Development, Health and Population, Water Resources, Agriculture and Cooperatives, and Physical Planning and Works as members, and the Secretary (Coordination) of the Office of the Prime Minister and Council of Ministers as member-secretary. The committee may delegate some or all of its powers to the Central or District Disaster Relief Committee.कोषको सञ्चालन र व्यवस्थापन राष्ट्रिय योजना आयोगका उपाध्यक्षको संयोजकत्वमा रहेको कोष सञ्चालन समितिले गर्छ। गृह, स्थानीय विकास, स्वास्थ्य तथा जनसंख्या, जलस्रोत, कृषि तथा सहकारी र भौतिक योजना तथा निर्माण मन्त्रालयका सचिव सदस्य र प्रधानमन्त्री तथा मन्त्रिपरिषद्को कार्यालयका सचिव (समन्वय) सदस्य–सचिव हुन्छन्। समितिले आफ्ना केही वा सबै अधिकार केन्द्रीय वा जिल्ला दैवी प्रकोप उद्धार समितिलाई प्रत्यायोजन गर्न सक्छ। Nepal Law Commission Rule 6(1)-(5) and Rule 8, PDF pp. 3-4
• The committee gives money to district-level disaster committees or other bodies for the uses listed. It decides the amount based on how serious and widespread the disaster is, how much money the fund has and whether the spending is justified, and it also bases its decision on recommendations from the Central and District Disaster Relief Committees. The Government of Nepal may give the committee directions on releasing money, and the committee must follow them.समितिले तोकिएका प्रयोजनका लागि जिल्लास्तरीय दैवी प्रकोप समिति वा अन्य निकायलाई रकम उपलब्ध गराउँछ। प्रकोपको सघनता र व्यापकता, कोषमा उपलब्ध रकम र खर्चको औचित्य हेरी समितिले उचित ठहराएबमोजिम रकम दिइन्छ र केन्द्रीय तथा जिल्ला दैवी प्रकोप उद्धार समितिको सिफारिसलाई पनि आधार बनाइन्छ। रकम उपलब्ध गराउने सम्बन्धमा नेपाल सरकारले समितिलाई निर्देशन दिन सक्छ र त्यसको पालना गर्नु समितिको कर्तव्य हुन्छ। Nepal Law Commission Rule 10(1)-(3) and Rule 11, PDF pp. 4-5
• The committee deposits the fund's money in an account at Nepal Rastra Bank or any commercial bank in Nepal. The account is operated by the joint signatures of the committee's member-secretary and the chief accounts officer or accounts officer of the Office of the Prime Minister and Council of Ministers.
