What does it do?
- The Government of Nepal made these rules under Section 23 of the Nepal Citizenship Act, 2063. They replaced the Nepal Citizenship Rules, 2049 and have been amended four times, most recently in 2082. A Nepali citizen aged 16 or over applies for citizenship by descent to the Chief District Officer (Schedule 1). They attach the citizenship certificate of a parent, or of a relative within three generations on the same side of the family, together with a local-government recommendation or birth certificate showing birthplace and relationship. A relationship certificate is needed when relying on a relative's certificate. Nepal Law Commission Title page and preamble, PDF p. 1; Rule 3(1), PDF pp. 1-2; Rule 19, PDF p. 19
- People who cannot produce those documents can be given citizenship on the basis of a field inquiry (sarjamin). In this inquiry, local residents with citizenship confirm the facts in the presence of a local-government official, or two citizen neighbours from the ward and one local official identify the applicant. The list of such applicants must be made public the same day. Separate routes cover people whose parents are both citizens and children found in Nepal whose parents are unknown. For a foundling, the parents' names are left blank on the certificate. They also cover a child of a Nepali mother who was born and lives in Nepal and whose father is not identified. That applicant and the mother must each make a self-declaration before the Chief District Officer (Schedule 4क). Nepal Law Commission Rule 3(2), (3), (3क)-(3ग), (6)-(6क), (8), PDF pp. 2-5
- The Chief District Officer issues certificates by descent and naturalised certificates based on marriage and other listed grounds. The CDO may delegate this to a gazetted first-class officer or a team chief, except for the descent cases under Section 3(5) and (5क) of the Act. The Home Ministry grants other naturalised citizenship, and the Council of Ministers grants honorary citizenship. If an applicant is found not eligible, the decision must be made and the applicant told within seven days. A person refused by a mobile citizenship team can apply to the Chief District Officer within 30 days, whose decision is final. Certificates must show the holder's gender identity as female, male or other. Nepal Law Commission Rule 6, PDF p. 6; Rule 8(1)-(5), PDF pp. 10-11; Rule 8ख, PDF p. 13; Rule 15(4), PDF p. 15
- A citizen who wants to give up citizenship notifies the Chief District Officer, or a Nepali embassy or consulate if abroad, with the original certificate. Citizenship ends when the notice is entered in the register. Corrections are made by the office that issued the certificate, which takes back the old one and issues a new one. A certificate obtained with false details is cancelled by the issuing office. A minor's identity card can be obtained from the Chief District Officer with the birth certificate, a parent's citizenship certificate and a local-government recommendation. This route was added by the fourth amendment. The card lapses at age 16 or if obtained with false details. Nepal Law Commission Rule 9(1)-(4), PDF p. 13; Rules 12 and 14, PDF pp. 14-15; Rule 16क, PDF pp. 17-18
Gaps, loopholes and improvement ideas
- Unclear Mothers must make a self-declaration to pass on citizenship when the father is unknown. In February 2025 the UN CEDAW Committee was concerned that women must make a self-declaration if the father is unknown, with penalties if it is false. It also found that women's ability to pass citizenship to their children is limited, which can leave children stateless, while Nepali fathers face no such requirements. These rules put that requirement into practice: the applicant and the mother each make a self-declaration (Schedule 4क) under Rule 3(3ख)(ङ). A child of a Nepali mother and a foreign father applying for naturalised citizenship needs a self-declaration from the applicant and the mother (Schedule 7क) under Rule 7(1)(ग). The Committee's review came before the fourth amendment of 2082, which revised Rule 3(3ख) but kept the self-declaration. UN Committee on the Elimination of Discrimination against Women · Nepal Law Commission CEDAW/C/NPL/CO/7, para 34(a), PDF p. 11; Rule 3(3ख)(ङ), PDF pp. 3-4; Rule 7(1)(ग), PDF p. 7
Ideas to fix it
- Remove the requirement of self-declaration, and the penalties, for Nepali mothers passing citizenship to children whose fathers are unidentified, and let Nepali women pass citizenship to a foreign spouse on the same terms as men. The Committee addressed this to Article 11(6) of the Constitution; the self-declaration is applied through these rules. Proposed by: UN Committee on the Elimination of Discrimination against Women UN Committee on the Elimination of Discrimination against Women · Nepal Law Commission
