What does it do?

  • When the Nepali Army urgently needs more soldiers because of internal security, an election, a natural disaster or another special reason, Army Headquarters may hire ex-servicemen up to the rank of Brigadier General (सहायक रथी) on contract, with Government approval and on the recommendation of a selection committee. A contract is normally for one year and can be extended. Army Headquarters may end it early if the person's work is unsatisfactory. Nepal Law Commission Rules 2(क), 3(1)-(4) and 4, PDF pp. 1-2
  • To be hired, an ex-serviceman must have served at least five years in the army he retired from, have basic military training and be found fit by a military hospital examination. Those with infantry experience get special preference. Candidates are screened by a committee chaired by the Adjutant General (कार्यरथी), with a Ministry of Defence officer and a colonel or lieutenant colonel named by the Chief of Army Staff. Hired ex-servicemen may serve until age 55. Nepal Law Commission Rules 5, 7(क)-(ग), 8 and 9, PDF pp. 2-3
  • A hired ex-serviceman gets the same pay and rations as a serving soldier of the same rank, keeps benefits he already received, and gets full treatment at military hospitals. Each year he gets 18 days of home leave, 12 days of sick leave and 6 days of casual leave. If he dies or is injured on duty, the Government pays compensation as it decides. He may not leave during the contract without good reason. Nepal Law Commission Rules 6 and 11-14, PDF pp. 2-4
  • While serving, hired ex-servicemen count as Nepali soldiers, and the Military Act and its rules apply to them for discipline and military action. Their service ends automatically if Army Headquarters no longer needs the post and gives 30 days' notice, or if they face departmental action or a military court. The Regulation repealed the Military Recruitment (Special Arrangements) Rules, 2018. Nepal Law Commission Rules 10, 16 and 18, PDF pp. 3-4
