What does it do?
- Licences to produce, distribute or exhibit films come from the Ministry of Communication and Information Technology. A licence to build and run a cinema hall comes from the District Coordination Committee in a rural municipality or from the municipality. A production application carries a Rs 50 stamp (Rs 1,000 for an advertisement film). Distribution costs Rs 10,000 for Nepali films and Rs 20,000 for films made abroad. Exhibition and cinema-hall licences cost Rs 10,000 to Rs 30,000 depending on the local body and hall category, and half in rural municipalities of declared remote districts. Nepal Law Commission Rules 3-5, PDF pp. 3-4
- A licensed producer must finish a feature film within three years and any other film within one year; for good reason, the Ministry may extend this by one year or three months if asked before expiry. Distribution and exhibition licences last five years. Distributors must renew within 35 days of expiry for Rs 7,000 (Nepali films) or Rs 20,000 (foreign films), and exhibitors pay Rs 8,000 to Rs 25,000. Late renewal costs extra, and a licence not renewed within the allowed time is cancelled automatically. Nepal Law Commission Rules 9(1)-(2) and 10(1)-(7), PDF pp. 8-10
- Nepali producers or distributors must submit films to a film censor committee: a central committee chaired by a Ministry joint secretary, or a local committee in districts outside the Kathmandu Valley that have cinema halls. Exhibitors may show only approved films, must show the certificate on screen first, may not cut a passed film without re-approval, and may not sell more tickets than seats. The committee may limit a film to people aged 16 or over, under-16s with a guardian, or certain professions. Fees are Rs 3,000, Rs 5,000 or Rs 15,000. Nepal Law Commission Rules 16(1)-(2), 17(1)-(6) and 18A, PDF pp. 12-15
- Cinema halls must meet the minimum facilities in Schedule 9, and the Ministry grades them A, B or C (halls showing video films are graded C). A new hall must be checked by a district committee chaired by the Chief District Officer. The Film Development Board must inspect every hall at least once every three years and order missing facilities to be provided within a set time; if the owner does not comply, it refers them to the relevant body for action. Showing films anywhere else needs Ministry approval. Nepal Law Commission Rules 6, 7, 8, 8A and 8B, PDF pp. 6-8
- A one-door committee chaired by the Ministry's Secretary sets policy for foreign producers filming in Nepal, and a producer licensed under that policy needs no separate permit from other bodies. The Ministry may assign a liaison officer, for whom the producer must provide food, lodging and transport, gear for mountain areas, term life insurance of at least Rs 3 lakh, and up to Rs 2 lakh compensation for disabling injury. Customs must release a foreign producer's filming equipment without a deposit, on condition it is taken back out. Nepal Law Commission Rules 5A-5B, PDF pp. 4-5; Rules 13(1)-(3) and 14, PDF pp. 10-11
