What does it do?
- This is a historical summary of the Environment Protection Rules, 2054, using the Law Commission's consolidated edition. Its first page gives the Nepal Gazette publication date as 2054/3/12 and lists five amending Rules: the first (2055, dated 2055/12/22), second (2069, 2069/12/26), third (2070, 2070/1/30), fourth (titled 2072 but dated 2073/1/13 as printed) and fifth (2073, 2073/10/17). The Government made the Rules under section 24 of the Environment Protection Act, 2053, and they took effect immediately. Footnotes in the schedules record further schedule changes by Gazette notices. The catalogue records the Rules as repealed from the Law Commission's repealed-laws listing; this edition does not say when or by what they were repealed, and no repeal date is inferred. Nothing here is current environmental assessment or permit guidance. Nepal Law Commissionनेपाल कानून आयोग Source accessed 2026-10-25 Title page, amendment list, preamble and Rules 1-2, PDF p.1 (date confirmed on a zoomed crop); schedule footnotes PDF pp.24-25 and 30; repeal status from catalogue
- A proposer had to carry out an initial environmental examination (IEE) for proposals listed in Schedule 1 and an environmental impact assessment (EIA) for those in Schedule 2. For an EIA, the proposer first published a notice in a national daily giving the village development committee or municipality, local schools, hospitals, health posts and other stakeholders 15 days to send written suggestions, then applied with those suggestions to the relevant body, which forwarded it with its opinion to the ministry to fix the scope. Terms of reference followed set formats: the relevant body approved them for an IEE and the ministry for an EIA. While preparing the report the proposer had to post a 15-day notice at the local body, district development committee, schools, hospitals and health posts, publish it in a national daily, include the comments received and, for an EIA, hold a public hearing in the project area. The report went in with 15 copies and the local body's recommendation. Source accessed 2026-10-25 Rules 3-7 and 10, PDF pp.2-5
- The relevant body approved an IEE-only proposal within 21 days if it found no significant adverse effect, or sent an EIA report with its opinion and ten copies to the ministry within 30 days. The ministry published a notice in a national daily giving the public 30 days to comment, and approved the proposal within 60 days if it found no significant adverse effect, with up to 30 more days for special reasons. The fourth amendment set shorter deadlines (mostly five to ten days, 20 for approval) for national pride projects, disaster-related projects and others the Government designated as urgent. The fifth amendment added supplementary EIA for changes to an already approved project; the ministry could allow it where, for example, added forest area was no more than ten per cent or resettlement involved up to 100 people (beyond 100 a fresh EIA was required). It also repealed the Supplementary EIA Directive, 2071. Proposers had to follow approved reports, the relevant body monitored impacts, and the ministry carried out an environmental audit two years after operation began. Source accessed 2026-10-25 Rules 11, 11ka-11chha (fourth and fifth amendments) and 12-14, PDF pp.5-9
- Nobody could emit noise, heat, radioactive radiation or waste beyond standards published in the Gazette. Industries listed in Schedule 7 needed a one-year temporary pollution control certificate, and a three-year permanent certificate after laboratory testing once standards were set; certificates carried conditions such as installing control equipment and operating only at set times, had to be renewed and displayed at the site. Any affected person, organisation, village development committee or municipality could complain to the relevant body, which could order immediate corrective steps and, if waste was still discharged, remove it at its own cost and recover that cost plus 25 per cent as a government arrear. The second amendment added rules for lead-acid battery businesses, which had to meet Schedule 8 standards and Schedule 9 conditions; the ministry's opinion was needed before registration, and a business that did not correct breaches could be closed and punished under the Act. Source accessed 2026-10-25 Rules 15-20 and 20ka-20gha (chapter 3ka, second amendment), PDF pp.9-14
- Environment inspectors could halt unlawful work, with ministry permission where possible, and the local administration had to provide police if they were obstructed; inspectors who acted maliciously faced punishment under existing law. The relevant body kept a public register of protected objects, sites, plants and animals after a notice allowing 30 days for objections, and nobody could remove, damage, gift or sell them without approval; anyone could complain about damage. Inside environment protection areas the Rules banned acts such as damaging natural resources, trading in or hunting wildlife, cutting vegetation, using electric current or harmful chemicals in rivers and ponds, mining, running hotels, lodges, transport or similar services, and entering without permission. Foreign organisations needed prior approval to collect samples of organisms, microbes or plants or to research biodiversity. An Environment Protection Fund was run as a revolving fund by a committee chaired by the secretary of the population and environment ministry, which had to publish an annual report. Source accessed 2026-10-25 Rules 21-44, PDF pp.14-20
- A person or organisation harmed by another's activity could apply to the Chief District Officer for compensation under section 17 of the Act, stating the harm and the amount sought. The Chief District Officer assessed the actual loss with the views of local offices and any inspector, could refer the matter to the relevant body, and had to decide within 60 days of the application (or 15 days after receiving the body's suggestion), fixing a fair and reasonable amount. The payer had 30 days to pay, extendable once by up to 30 days; if it still did not pay, the claimant could apply within three months to recover the amount by auction of the payer's property. The Rules named who imposed penalties under section 18 of the Act: the relevant body for IEE, pollution-certificate, register and foreign-research breaches, and the ministry for EIA and other breaches. The penalty amounts themselves are in the Act, not in these pages. The ministry could also give cash awards, certificates and an environment-friendly mark. Source accessed 2026-10-25 Rules 45-49, PDF pp.20-23
