Civil Aviation Regulation, 2052

What does it do?

• No one may fly or operate an aircraft in Nepal's airspace against the Civil Aviation Act, this regulation, the ICAO annexes or the manuals of the Civil Aviation Authority of Nepal, and no one may fly without the Authority's flight permission. An aircraft must be registered, carry its country's nationality marks and hold an airworthiness certificate, and only crew with personal licences, ratings and certificates may fly it.गैर सैनिक हवाई उडान ऐन, यो नियमावली, एनेक्स तथा म्यानुअल विपरीत हुने गरी कसैले पनि नेपालको हवाई क्षेत्रमा हवाई उडान तथा सञ्चालन गर्न हुँदैन, र नेपाल नागरिक उड्डयन प्राधिकरणको उडान अनुमति नलिई उडान गराउन हुँदैन। वायुयान दर्ता भएको, दर्ता भएको मुलुकको राष्ट्रिय चिन्ह अंकित भएको र उडान योग्यताको प्रमाणपत्र प्राप्त हुनुपर्छ। व्यक्तिगत इजाजतपत्र, रेटिङ तथा प्रमाणपत्र प्राप्त क्रूले मात्र वायुयान उडाउन पाउँछ। Nepal Law Commission Rules 3-8, PDF pp. 2-3
• Every flight must carry the registration and airworthiness certificates, the journey log book, each crew member's licences and, on a passenger aircraft, the name, nationality, landing place and final destination of every passenger. • Before take-off the pilot in command must be satisfied that the aircraft's weight is safe, its load is balanced and secured, and it has the required fuel plus reserve. Aircraft may not fly without the life-saving and fire-fighting equipment required by the annexes and manuals. Crew may not drink in a way that impairs their work, no one may smoke except when the Authority allows it, and, unless the Director General orders otherwise, people of unsound mind, prisoners serving a sentence and animals or birds may not knowingly be carried.वायुयानको कुल तौल सुरक्षित भएको, सामान सन्तुलित र बाँधेर राखिएको र आवश्यक तथा न्यूनतम जगेडा इन्धन भएकोमा वायुयान चालक (पाइलट इन कमाण्ड) सन्तुष्ट नभई उडान गर्न हुँदैन। एनेक्स र म्यानुअलले तोकेका जीवनोद्धार तथा अग्नि निवारण सामग्रीबिना उडान गर्न पाइँदैन। क्रूले उडान क्षमतामा असर पर्ने गरी पेय पदार्थ सेवन गर्न हुँदैन, प्राधिकरणले तोकेको अवस्थाबाहेक धूम्रपान गर्न हुँदैन, र महानिर्देशकले अन्यथा आदेश नदिएसम्म मानसिक सन्तुलन गुमाएका व्यक्ति, कैद भोगिरहेका व्यक्ति र जीवजन्तु वा चराचुरुङ्गी जानीजानी वायुयानमा राख्न हुँदैन। Nepal Law Commission Rules 15-23, PDF pp. 4-6
• Only the Authority may arrange lights and signals at airports; no one else may put up towers, poles or other things that could mislead pilots. Every public passenger aircraft registered in Nepal must have radio and navigation-aid equipment. Apart from passengers, airport and flight staff and people handling cargo and mail, no one may enter an airport area without the order of the Director General or an authorised person. No slaughterhouse may be set up within three kilometres of an airport area, and no one may dump polluting waste around an airport.विमानस्थल क्षेत्रमा प्रकाश र संकेतको व्यवस्था प्राधिकरणले मात्र गर्छ; अरू कसैले वायुयान चालकलाई भ्रम पर्ने गरी टहरा, टावर, लठ्ठा जस्ता कुरा खडा गर्न हुँदैन। नेपालमा दर्ता भएका प्रत्येक सार्वजनिक यात्रुबाहक वायुयानमा रेडियो सञ्चार तथा उड्डयन सहायक उपकरण जडान हुनुपर्छ। हवाई यात्रु, उडान र विमानस्थलको काममा संलग्न व्यक्ति तथा मालसामान र चिठीपत्र ओसारपसार गर्ने व्यक्तिबाहेक अरूले महानिर्देशक वा अधिकारप्राप्त व्यक्तिको आदेशबिना विमानस्थल क्षेत्रमा प्रवेश गर्न पाउँदैनन्। विमानस्थल क्षेत्रको तीन किलोमिटर वरपर वधशाला स्थापना गर्न र विमानस्थल वरपर वातावरण दूषित पार्ने फोहोर थुपार्न पाइँदैन। Nepal Law Commission Rules 73-77, PDF pp. 7-8
• Every aircraft registered in Nepal must keep up-to-date journey, aircraft, engine, propeller and radio log books. The Authority may give orders and directions to make people follow the annexes and manuals, apply ICAO annexes and documents, and make its own manuals, requirements and directives, which bind everyone involved in air transport. Many original chapters (Rules 24-72) and the schedules were repealed by the First Amendment, 2058.नेपालमा दर्ता भएका प्रत्येक वायुयानले यात्रा, वायुयान, इन्जिन, प्रोपेलर र रेडियो पार्ट्सको लगबुक अद्यावधिक राख्नुपर्छ। एनेक्स र म्यानुअल पालना गराउन प्राधिकरणले आदेश तथा निर्देशन दिन, अन्तर्राष्ट्रिय नागरिक उड्डयन संगठनका एनेक्स र म्यानुअल लागू गर्न र आफ्नै म्यानुअल, रिक्वायरमेन्ट्स तथा डाइरेक्टिभ्स बनाउन सक्छ, जुन हवाई यातायात सेवासँग सम्बद्ध सबै पक्षलाई लागू हुन्छन्। पहिलो संशोधन, २०५८ ले मूल नियमावलीका धेरै परिच्छेद (नियम २४ देखि ७२) र अनुसूचीहरू खारेज गरेको छ। Nepal Law Commission Rules 78-82; Chapters 4-9 and Schedules 1-3 (repealed), PDF pp. 6, 8-10, 12
