What does it do?
- This is a historical summary of the Forest Rules, 2051, using the Law Commission's consolidated edition. Its first page gives Nepal Gazette publication on 2051/12/20 and lists five amending Rules, dated 2056/5/21, 2059/4/27, 2062/6/10, 2070/1/30 and 2072/6/25. The Government made the Rules under section 72 of the Forest Act, 2049, and they came into force at once. Rule 69 repealed six earlier sets of rules, among them the Forest Produce Sale and Distribution Rules 2027, the Panchayat Forest and Panchayat Protected Forest Rules 2035, the Leasehold Forest Rules 2035 and the Private Forest Rules 2041. The catalogue records these Rules as repealed from the Law Commission's repealed-laws listing; this edition does not say when or by what they were repealed, and no repeal date is inferred. Nothing here is current forest-use guidance. Source accessed 2026-10-25 Title page, amendment list, preamble and rule 1, PDF p.1; rule 69, PDF p.34; repeal status from catalogue
- For government-managed forests, the Department of Forests had to prepare a management work plan for one or more districts covering forest area, maps, local people's needs, annual harvest and revenue estimates, and soil, tourism, environmental and heritage protection. Nobody could take, collect, remove, sell, transport or export any forest product without a permit from the district forest officer, and timber had to carry the Department's hammer mark. Applicants named the product, area, quantity, purpose and place of use and paid the price, fee or charge in advance. In districts named by Gazette notice, a District Forest Product Supply Committee chaired by the district forest officer distributed timber and firewood for rural households, small community development works, disaster relief and farm tools; such wood could not be used for other purposes or taken out of the district. Timber was priced under Schedule 2 (for example, rates per cubic foot for sal logs of Rs 800, 500 and 300 by grade in the amended schedule) or sold by auction. Source accessed 2026-10-25 Rules 2-9, PDF pp.1-7; Schedule 2 timber rates (amended by Gazette notice 2068/2/23), PDF p.36
- Other provisions for government-managed forests: medicinal herbs listed in Schedule 3 could be collected only under a permit and were released after checking against it and paying the fee; the Government could ban collection, sale, transport or export of specific forest products by Gazette notice, and the district forest officer could recommend exports of non-banned products to customs. Within the work plan's annual quantity, timber and firewood could be given free for traditional religious work as decided by the Government. Timber collection seasons were set by Gazette notice for some districts (Kartik to Jestha) and up to eight months elsewhere, with a two-month extension possible. Grazing needed a permit and fee. The Government could hand forest areas to national or international organisations by auction for forest development, and the Rules set spending limits for forest offices' own works, with a district forest officer able to authorise auction sales of forest products up to Rs 5 lakh and the Director General up to Rs 25 lakh. Source accessed 2026-10-25 Rules 11-23 and 66, PDF pp.7-12 and 34
- Community forests: the district forest officer could hand part of a national forest to a local users' group, considering distance from the village and the users' wishes and capacity. Users applied in writing; forest staff helped them form a group and draft a constitution by consensus, unaffected by ward, village, municipal or district boundaries, and the officer registered the group and issued a certificate. The group prepared a work plan (forest description, maps, blocks, protection, nursery and planting, herbs, use of income, penalties for users under section 29 of the Act, wildlife). After approval the forest was handed over with a certificate. Groups could not clear forest, sell, mortgage or transfer the land, cultivate, build houses or sheds, cause erosion, hunt illegally, or extract stone, soil, gravel or sand, though with approval they could mortgage forest products for a loan or build a guard shelter. Groups sold only work-plan products, replanted, issued permits and receipts, registered their hammer mark free of charge, ran their fund on two joint signatures and filed an annual audit. If a group broke its plan, the Act, the Rules or the conditions, or harmed the environment, the district forest officer could, after asking for an explanation within 15 days, take the forest back and cancel the registration; the group could complain to the regional director within 35 days, who had to decide within 90 days. Source accessed 2026-10-25 Rules 26-38, PDF pp.13-19
- Leasehold forests: organised institutions, industries or communities could apply for a leasehold forest with a feasibility report. Before granting it, the regional director had the district forest office publish a 35-day notice at the village development committee or municipality and other public places asking whether nearby users wanted the area as a community forest; if they did, the lease application was set aside and the district forest office was directed to form a users' group within three months. Where several applicants competed, communities mostly below the poverty line had first priority and forest-product industries that planted trees came second. A rule added by the second amendment let the Government invite proposals for degraded, encroached, disaster-hit, low-cover (under 20% crown cover) or erosion-sensitive land, assessed by a committee led by the Director General on conservation, revenue, local jobs and income; the agreement had to bar diverting streams, harming habitats or wetlands, poisoning wildlife, quarrying stone, gravel or sand, and blocking locals' traditional use of paths, fords and rivers. The Government could also hand leasehold forests to poor communities through a project. Leases ran up to 40 years, renewable for 40 more; trees already standing remained government property; the leaseholder paid an annual fee by the end of Asar, with 10%, 50% and 100% surcharges for late payment and cancellation after that; land could not be sold or mortgaged, but after a third of the term the lease could be transferred with ministry approval. Breaches could lead to cancellation after a hearing of up to 35 days, with compensation for planted products assessed under Schedule 2 and disputes on valuation settled under the Arbitration Act 2055. Source accessed 2026-10-25 Rules 39-54 (39A added by second amendment; rule 53(5) as amended by fourth amendment), PDF pp.19-29
- Religious and private forests: a registered religious body, group or community could apply to manage a forest it had traditionally used for religious purposes; the district forest officer could hand it over with a certificate, products were to be used only for religious work (non-timber products could be sold to fund it), and the forest could be taken back after a hearing of up to 35 days, with a final appeal to the regional director. Anyone could register a private forest on land they owned, with the tree species and numbers recorded and a certificate issued. Owners of registered private forests could use or transport products after giving the district forest office at least 24 hours' written notice with the species and quantity and a recommendation from a member of the village development committee or municipality. After the fifth amendment, owners of unregistered private forests could fell trees listed in Schedule 26 and move them, and move herbs or other products listed in Schedule 27, without a permit or release slip, but had to have records certified by the forest office using Schedules 28 and 29. Schedules 26 to 29 themselves were not read. Source accessed 2026-10-25 Rules 55-64 (rule 62 as amended and 62(4a)-(4c) added by fifth amendment), PDF pp.29-33
