What does it do?

• To register an establishment-level union, an officer chosen by its executive committee must apply to the Registrar on the Schedule-1 form with a Rs 150 fee. The application must list the union's name, address and founding date, three copies of its constitution, its officers, and every member's name, age, job and length of service, plus a statement that the members have not joined another union at the same establishment. If everything is in order, the Registrar enters the union in the register and issues a certificate.प्रतिष्ठानस्तरको ट्रेड युनियन दर्ता गराउन कार्य समितिले तोकेको पदाधिकारीले एक सय पचास रुपैयाँ दर्ता दस्तुरसहित अनुसूची-१ को ढाँचामा पञ्जिकाधिकारीसमक्ष दरखास्त दिनुपर्छ। दरखास्तमा युनियनको नाम, ठेगाना, गठन मिति, विधानका तीन प्रति, पदाधिकारीको विवरण र प्रत्येक सदस्यको नाम, उमेर, काम र सेवा अवधि खुलाउनुपर्छ। सदस्यले सोही प्रतिष्ठानको अर्को युनियनको सदस्यता नलिएको स्वीकारोक्ति पनि चाहिन्छ। रीत पुगेमा पञ्जिकाधिकारीले दर्ता किताबमा दर्ता गरी प्रमाणपत्र दिनुपर्छ। Nepal Law Commission Rules 3(1)-(2) and 4, PDF pp. 1-2; Schedules 1-2, PDF pp. 9-10
• Larger bodies register the same way, with higher fees: Rs 500 for a trade union federation (with a copy of the agreement between its member unions) and Rs 1,000 for a trade union confederation (with a copy of the agreement between its member federations). • A union must apply to the Registrar to renew its registration three months before the period in Section 7क of the Act ends. The fee is Rs 75 for an establishment-level union, Rs 250 for a federation and Rs 500 for a confederation. Late applications within that period pay 25 per cent extra; after a Registrar's notice, a union may still apply within six months of expiry with 50 per cent extra. • To decide which union in an establishment speaks for the workers in collective bargaining with management, the Registrar must hold an election to see which union has the support of a majority of workers. The Registrar may appoint an employee as election officer, and must issue election directives with government approval. The establishment must pay the full cost of the election.
