What does it do?
- Applications for survey, generation, transmission or distribution licences go in three copies to the Director General of the Department of Electricity Development. The Director General issues licences for hydropower up to 100 MW (other than storage or multipurpose projects), solar, wind, biomass and waste power, transmission and distribution; other generation applications go to the Secretary with a recommendation. Before a generation, transmission or distribution licence, the Department publishes a notice, and anyone may raise significant harms within 35 days. Nepal Law Commission Rules 4, 8(1)-(3), 12, 16(1)-(3) and 17(1)-(3), PDF pp. 3, 5-6, 11-13
- If documents are missing, the Director General must tell the applicant within 15 days for a survey licence and within 45 days for a generation, transmission or distribution licence. No second survey licence is given for the same work in the same area during an existing licence. A survey licence holder must submit the survey report within 30 days of finishing the survey. Nepal Law Commission Rules 7(2), 10, 11 and 15(2), PDF pp. 5-6, 11
- Licence holders must start physical work within three months of a survey licence and within one year of a generation, transmission or distribution licence, then report progress every six months. The deadline may be extended for good reason. They must renew the licence one year before it expires, submit accounts of income and spending within six months after each fiscal year and send annual reports. Selling or transferring a licence needs approval, and a licence may be cancelled for breaches. Nepal Law Commission Rules 21(1)-(2), 25(1), 89, 90 and 91, PDF pp. 13-15, 33-34
- Survey licence applicants deposit the Schedule-11 fee, which goes to government revenue if the licence is granted and is refunded if it is not. The deposit is also forfeited if a granted licence is not collected within three months. Schedule 11 sets one-off generation licence fees from Rs 5 lakh (above 1 MW up to 5 MW) to Rs 50 lakh (above 500 MW), and a survey fee for solar and wind of Rs 10,000 per MW a year. Nepal Law Commission Rule 24(1)-(4), PDF p. 15; Schedule 11 (क1) and (ग), PDF pp. 52-53
- A person wanting electricity applies to the licensed distributor, which checks the wiring and gives a cost estimate; disputes go to the chief electrical inspector. The distributor may take a reasonable meter deposit, refunded when supply ends. If a customer says the meter is faulty or running fast, the distributor must test it within 15 days, repair or replace a fast meter free, and make good the loss for up to one month before the complaint. Customers must not supply others from their meter. Nepal Law Commission Rules 28(1)-(6), 29(1)-(8) and 31, PDF pp. 16-18
