Summary updated 2026-10-25

  • This is a historical summary of the Tea Estate Labour Rules, 2050, using the Law Commission's edition. Its first page gives the Nepal Gazette publication date as 2050/7/23 and lists no amendments. The Government made the rules under section 86 of the Labour Act, 2048, and they came into force immediately. A 'tea estate' meant a tea garden registered for commercial purposes, including any factory set up on it. A 'worker' covered anyone digging, ploughing, levelling, weeding, planting, pruning or plucking on estate land, and anyone cleaning its buildings or machinery. Under rule 52, where these rules were silent, the Labour Rules, 2050 applied. The catalogue records these rules as repealed, citing the Law Commission's repealed-laws listing and rule 88(1) of the Labour Rules, 2075. No further repeal detail is inferred here, and nothing in this summary is current guidance for tea workers. Source accessed 2026-10-25 Title page, preamble and rules 1-2, PDF p.1; rule 52, PDF p.17; repeal status from catalogue
  • Hiring, hours and pay. As in the general Labour Rules, minors over 14 and under 16 could not work more than 6 hours a day or 36 hours a week. Minors over 16, and women, could work outside 6 a.m. to 6 p.m. only by mutual agreement, and the manager had to arrange women's safety. The register had to record each worker's appointment date, post, address, date of birth, citizenship, assigned task work and facilities. A skilled non-Nepali could be hired for up to two years at a time only if no skilled Nepali was available, with Labour Department approval, and Nepali workers had to be trained to replace them. Retrenchment followed the same order as the general rules. A minimum wage fixation committee of equal worker, management and government representatives recommended minimum wages for tea estate workers. Men and women had to receive equal pay for the same or similar work. Wage deductions were capped at the same per-payment percentages as the general rules (33, 25, 25 and 50 per cent). A welfare fund received 70 per cent of the remaining bonus amount under the Bonus Act, 2030 and was run by the labour relations committee for the same welfare purposes. Under rule 49, each tea estate set the nature and quantity of the daily task workers had to complete. Source accessed 2026-10-25 Rules 3-14 and 49, PDF pp.1-5 and 16
  • Compensation, gratuity and provident fund: several entitlements were lower than in the general Labour Rules. Injury treatment costs and wages during treatment matched the general rules: full pay in hospital and half pay at home, for up to a year. For 100 per cent disability, however, the lump sum equalled four years' wages, against five in the general rules; partial disability was paid proportionately using the same style of schedule. Death compensation was three years' wages to the nearest heir, and the natural-disaster exclusion and higher-of-insurance rule also applied. Gratuity required four or more years of permanent service, against three in the general rules. The rate was one-third of a month's pay for each of the first ten years, half a month's pay for each year from ten to fifteen and two-thirds for each year beyond fifteen. The three bands were capped at Rs 7,000, Rs 15,000 and Rs 20,000 respectively. The provident fund deduction was 5 per cent of monthly pay, against 10 per cent in the general rules, with the estate adding an equal amount. Withdrawal, nominee and 50 per cent loan rules matched the general ones. Source accessed 2026-10-25 Rules 15-26 and Schedule, PDF pp.6-9 and 18-22
  • Medical care and leave. A worker with a serious, long illness could receive medical treatment support, on a recognised doctor's recommendation, of up to two months' wages over the whole period of service. An estate could require a fitness certificate, or arrange a health examination, before appointing someone. Workers were entitled to: 13 days of paid public holidays; home leave of one day for every 30 days worked (against 20 in the general rules), accumulable up to 60 days and paid out on leaving; 15 days' sick leave at half pay after a year's service; up to 13 days' paid mourning leave; and up to 30 days a year of unpaid special leave, limited to six months over a career. Maternity leave was 45 days at full pay, available only twice in a career, unless the two children were not living. Leave was described as a facility, not a right. A worker absent for more than 30 consecutive days without notice or approval could be removed. Source accessed 2026-10-25 Rules 27-38, PDF pp.9-11

The load limits were the same as in the general rules: 55 kg for adult men, 45 kg for adult women, 25 and 20 kg for male and female minors aged 16-18, and 15 kg for minors aged 14-16. Labour offices could appoint officers to investigate occupational disease or accidents. Each estate had a labour relations committee of 4 to 20 members with equal management and worker representation; worker representatives were nominated by the estate-level trade union or, if there was none, by the workers. The committee had a two-year term and had to meet at least once a month, against once every three months in the general rules. A welfare officer's duties included promoting good relations, explaining workers' rights in simple language and arranging health check-ups. Managers had to notify the labour office at least 15 days before establishing or expanding an estate, and within 30 days of the rules' commencement send the estate's name, address, manager and worker details. Source accessed 2026-10-25 Rules 39-51, PDF pp.12-17
