Radio Communications (Licence) Regulation, 2049

What does it do?

• A licence is needed to keep, use, manufacture, sell or distribute radio equipment, and to work as an amateur radio operator. No licence is needed for sets that only receive radio or TV broadcasts, for radio-control toys, cordless microphones and cordless phones with a range under 30 metres that meet Ministry standards, or for other equipment named in the Nepal Gazette. Applications go to the licensing officer named by the Ministry of Communication and Information Technology, and no licence may be given if it would harm public communication services.रेडियो यन्त्र राख्न, प्रयोग गर्न, उत्पादन गर्न वा बिक्री वितरण गर्न तथा एमेच्योर रेडियो सञ्चालक हुन लाइसेन्स लिनुपर्छ। रेडियो वा टेलिभिजन प्रसारण सुन्ने-हेर्ने यन्त्र, मन्त्रालयले स्तर तोकेका रेडियो कन्ट्रोल खेलौना, कर्डलेस माइक्रोफोन र ३० मिटरभन्दा कम दूरीका कर्डलेस टेलिफोन तथा नेपाल राजपत्रमा सूचना प्रकाशित गरी तोकिएका यन्त्रका लागि लाइसेन्स चाहिँदैन। सञ्चार तथा सूचना प्रविधि मन्त्रालयले तोकेको लाइसेन्स दिने अधिकारीसमक्ष दरखास्त दिनुपर्छ र सार्वजनिक सञ्चार सेवामा प्रतिकूल असर पर्ने गरी लाइसेन्स दिइँदैन। Nepal Law Commission Rules 2(c), 3(1)-(2), 4(1)-(2) and 18, PDF pp. 1-3 and 7
• A licence lasts one fiscal year. To renew, the holder must apply before it expires and pays half the licence fee. Late renewal carries a penalty of 10%, 20%, 30%, 40% and 50% of the fee for the first to fifth month late and 100% in the sixth month; a licence not renewed within six months is cancelled automatically. • Licence fees for Nepali citizens are listed in Schedule 7. Examples: Rs 300 for a satellite receiver for public broadcasts; Rs 1,000 for an amateur control operator with equipment and Rs 600 for an amateur operator without; Rs 5,000 to Rs 25,000 for an FM station's equipment, depending on power; and Rs 2,00,000 to manufacture equipment commercially. • An amateur radio licence may be given to a Nepali citizen aged at least 16 who speaks and writes Nepali and English well and has passed written and oral exams on a syllabus approved by the Ministry; foreigners may get one for a short period. • When licensed equipment is sold or handed over, both parties must apply within 35 days to transfer the licence. Dealers must keep a register of each sale (date, type of equipment, buyer's name and permanent address) and send it to the licensing officer every six months. Equipment that breaks down or is lost must be reported within 35 days. Changing licence details or getting a duplicate costs Rs 100.
