What does it do?

  • Every newspaper or periodical publisher must, within three months after each fiscal year ends, have its circulation audited by a certified auditor and send the report to the Press Council's circulation audit committee. After checking it, the committee must give the publisher a circulation audit certificate in the form set out in the Schedule. Nepal Law Commission Rule 5(1)-(2), PDF p. 2; Schedule, PDF pp. 5-6
  • The audit report must show, for each issue, how many copies were printed and how they were distributed: sold to subscribers; given to staff, members, agents or regular contributors; sold through bookshops or agents; and given free to libraries or reading rooms. It must also show copies returned or unsold. Nepal Law Commission Rule 8(1)-(2), PDF pp. 3-4
  • Anyone who believes a circulation report is false may complain to the committee within one month of its filing. The committee may investigate or order a fresh audit. If the complaint is upheld, the publisher gets no certificate, or loses one already given, and its facilities may be suspended for a set period on the committee's recommendation; the publisher pays the costs. If the complaint proves false, the complainant pays the costs. Nepal Law Commission Rule 6(1)-(5), PDF pp. 2-3

Council meetings need an agenda sent to all members, normally 48 hours ahead. If the chair is vacant or unable to act, the Government of Nepal may name a member as acting chair for up to one year. The Council has its own secretariat in the Kathmandu Valley. Nepal Law Commission Rules 7, 3(2) and 3A, PDF pp. 1-3; Rules 9-10, PDF p. 4
