What does it do?
- Anyone who wants, inside a protected monument zone, to lay telephone or power lines, dig for water or sewerage, build or repair a road, hold a festival, fair or dance, park vehicles, or put up posters or pictures must apply to the Department of Archaeology. The Chief Archaeological Officer approves the work if it will not harm the zone. After consulting the Technical Committee, the Department sets the style and standards for building on private land in each zone and posts them on the zone office's notice board. Nepal Law Commission Rules 4.1.1-4.1.2 and 4.2, PDF p. 7
- Each year by the end of Asar, the Chief District Officer must send the Chief Archaeological Officer details, with photos where possible, of archaeological objects in the district, and must report a newly found object within 35 days of learning of it. Archaeological excavation at an ancient monument site needs prior Government approval: the application goes to the Department, which forwards it with its recommendation to the Ministry of Culture, Tourism and Civil Aviation. Nepal Law Commission Rules 4.3.1-4.3.2 and 4.4.1-4.4.2, PDF pp. 7-8
- Repair and renovation of monuments must keep their originality and sensitivity and protect national art and culture, using a research-based approach. Where normal tendering cannot do this or risks destroying the monument, the Department may use quotations or direct works by people or firms experienced with monuments, pre-qualified by a committee after a notice in Gorkhapatra. A separate committee sets special wage rates for workers and artisans and prices for traditional building materials. Nepal Law Commission Rules 4.5.1-4.5.3, 4.6.1 and 4.8.1, PDF pp. 8-10
- An Ancient Monument Conservation Fund takes Government money, donations, foreign and international aid, filming and entry fees, and income from Department publications. It is spent on renovating and conserving private or public monuments important for their history, art, architecture, religion or culture; money given for a particular monument may be spent only on that monument. A committee chaired by the Secretary of the Ministry of Culture, Tourism and Civil Aviation runs the fund, which is audited by the Office of the Auditor General. Nepal Law Commission Rules 4.10.1-4.10.4 and 4.11.1, PDF pp. 11-12
- Filming a feature film, TV film, documentary or advertisement in a protected monument zone needs the Department's prior approval, with the story or script attached and the owner's permission for a privately owned zone. Fees are Rs 2,000 per feature film and Rs 500 per TV film, documentary or advertisement by Nepali citizens or bodies, and US$300 and US$100 (or the equivalent in Nepali rupees) respectively for foreign ones. The Government may waive fees for its own programmes or non-profit public-welfare bodies. A Department officer must be invited to censorship, and unapproved scenes may be cut. Nepal Law Commission Rules 4.12.1-4.12.5 and 4.13; Schedule 7, PDF pp. 13-14, 21
