What does it do?
- A drug inspector may go to any place where drugs are produced, sold, distributed or transported to inspect the work, people, conditions, materials and equipment there, and may search it. The inspector must first get the permission of the drug owner or their representative. If permission cannot be obtained or is refused, the inspector may go ahead with a witness from the local body or a nearby government office, normally between sunrise and sunset. No one may obstruct an inspector. Nepal Law Commission Rules 3, 4 and 21, PDF pp. 2, 7
- The inspector may seal and hold drugs, leaving them in the owner's custody; the owner must accept them and give a receipt. If the owner refuses, the inspector seizes the drugs and gives a receipt. If the inspector finds another substance that could be mixed into drugs and the owner cannot explain its use, the inspector may order it removed, and the owner must remove it. Nepal Law Commission Rules 5(1)-(2), 6(1)-(2) and 7(1)-(2), PDF pp. 2-3
- When inspecting or holding drugs, the inspector takes samples in the quantity set by the Department of Drug Administration and pays the going price. The samples go into separate sealed containers: one for the owner, one for the analyst and one for the Department. The owner and inspector each stamp the seal in at least four places; if the owner will not, a local witness is used. The analyst checks the seals, tests the sample and reports in the set format. Nepal Law Commission Rules 8(1)-(4), 9, 10(1)-(2), 14 and 15(1)-(2), PDF pp. 3-6
- Within three days of finishing an inspection or search, the inspector must give a written report to the head of the Department. It must state why the place was inspected, which drugs, materials and people were involved, why any drug was held, seized or sampled, and how much was sealed and given to whom. Nepal Law Commission Rule 12(1)-(2), PDF pp. 4-5
- In a prosecution under the Drugs Act, the drug owner may ask the officer hearing the case to have their own sealed sample re-tested, and the owner bears the cost. If the analyst finds a held or seized drug safe, effective and of good quality, the head of the Department must release it. The government may recognise domestic or foreign laboratories for testing on the advice of the Drug Consultative Council. Nepal Law Commission Rules 16(1)-(3), 17, 18(1) and 20, PDF pp. 6-7
