What does it do?
- The Compensation Determination Committee fixes the compensation for land that the Government of Nepal acquires for public roads, within the Public Road Act, 2031 and this Regulation, and recommends the amount to the Government. To do this it may ask the office that keeps the land records for details, inspect the land to find its prevailing price on the date it was acquired, and have a member or another person inspect the land.मुआब्जा निर्धारण समितिले सार्वजनिक सडकका लागि नेपाल सरकारले प्राप्त गरेको जग्गाको मुआब्जा सार्वजनिक सडक ऐन, २०३१ र यस नियमावलीको अधीनमा रही निर्धारण गरी नेपाल सरकारसमक्ष सिफारिस गर्छ। यसका लागि समितिले जग्गाको लगत रहेको कार्यालयबाट विवरण माग्न, जग्गा प्राप्त गर्दाको मितिमा त्यसको प्रचलित मोल निर्धारण गर्न जाँचपडताल गर्न र समितिका सदस्य वा अन्य व्यक्तिबाट जग्गाको जाँचपडताल गराउन सक्छ। Nepal Law Commission Rule 3(1)(क)-(ङ), PDF pp. 1-2
- A compensation sub-committee does the same work under the Committee's policy and direction. It fixes compensation for land the Government has acquired and sends its recommendation to the Government through the Committee, and it may also check the land's prevailing price and obtain details from the land-records office.मुआब्जा निर्धारण उपसमितिले समितिको नीति निर्देशनको अधीनमा रही यही काम गर्छ। उपसमितिले नेपाल सरकारले प्राप्त गरेको जग्गाको मुआब्जा निर्धारण गरी समितिमार्फत नेपाल सरकारसमक्ष सिफारिस गर्छ र जग्गाको प्रचलित मोल जाँचपडताल गर्न तथा लगत रहेको कार्यालयबाट विवरण लिन पनि सक्छ। Nepal Law Commission Rule 4(1)(क)-(ङ), PDF pp. 2-3
- When houses, buildings, walls or similar structures are acquired along with the land, the Committee or sub-committee must fix their compensation under Section 11 of the Act and the guidelines the Government issues from time to time. Both bodies meet when their chair decides, decide by majority (the chair has a casting vote), and their decisions are certified by the member-secretary.
