What does it do?

  • A person or organisation that wants to run a lottery must apply for government approval to the Ministry of Home Affairs through the local Chief District Officer, using the form in the Schedule and attaching two sample tickets. The Chief District Officer must look into the application and forward it with an opinion, and the Ministry may then grant permission. For a lottery drawn only at a public exhibition ground, club or society, the Chief District Officer may grant permission directly. Nepal Law Commission Rule 3(1)-(4) and Schedule, PDF pp. 1, 3
  • If prizes have to be changed, the organiser must tell the Chief District Officer within seven days of ticket sales closing, and before the draw, how many tickets were sold and unsold and the proportionate prize amounts. Any change to the draw date or place needs the Chief District Officer's approval. The Chief District Officer sends an officer, with staff, to oversee the draw. Nepal Law Commission Rules 4, 6 and 7, PDF p. 2
  • The day after the draw, the organiser must give the Chief District Officer full details: tickets sold and unsold, the names of prize winners, the numbers of winning tickets and any change to prizes. The winning ticket numbers, with names where known, must be published in newspapers as soon as possible. Nepal Law Commission Rules 5 and 8, PDF p. 2
  • Except for lotteries approved by the Chief District Officer for exhibition grounds, clubs or societies, the income and expenditure of every lottery must be audited at the local District Administration Office. The application form asks for the purpose of the lottery, its capital, the share of total sales to be given as prizes, and how the remaining money will be split between costs and charity or profit. Nepal Law Commission Rule 9 and Schedule, PDF pp. 2-3
