What does it do?
- This ordinance amends section 33(2) of the Political Parties Act, 2073 on forming a new party by splitting from an existing one. Previously at least forty percent of both the central committee and the federal parliamentary party were required; under the ordinance, at least forty percent of the central committee elected by the general convention (or, for a newly registered party, the central committee at registration) or at least forty percent of the party's federal parliamentary party, acting at one time, are enough. Federal Parliament Secretariat (hr.parliament.gov.np) — ordinance text as tabled in the House of Representatives Section 2, PDF p. 1; comparison table PDF pp. 2–4
- It also lets such a new party register for elections, exempts a new party formed by members of a recognised national party from meeting the proportional-vote threshold to be treated as a national party, and requires the new party's central office-bearers and members to submit property details within sixty days of its registration. Federal Parliament Secretariat (hr.parliament.gov.np) — ordinance text as tabled in the House of Representatives Sections 3–5, PDF p. 1
- Under Article 114 of the Constitution, an ordinance has the same force as an Act, but it must be tabled at the next session of both Houses; it ceases to have effect if both Houses do not adopt it, if the President repeals it, or sixty days after both Houses meet. The House of Representatives' ordinance-status list records that it was tabled for information only because the President had already withdrawn it. Nepal Law Commission · Federal Parliament of Nepal Article 114(1)–(2), PDF p. 62; HoR ordinance-status entry
