What does it do?
- This ordinance, the Nepal Police and Province Police (Operation, Supervision and Coordination) (First Amendment) Ordinance, amends the Nepal Police and Province Police (Operation, Supervision and Coordination) Act, 2076. It was issued under Article 114(1) of the Constitution because Parliament was not in session. Federal Parliament Secretariat (hr.parliament.gov.np) — ordinance text as tabled in the House of Representatives Preamble and Section 1, PDF p. 1
- Its main change is a new section 10A: notwithstanding sections 8 and 9, in Kathmandu, Lalitpur and Bhaktapur districts the Nepal Police (the federal force) exercises the functions, duties and powers of the Province Police and also investigates offences that the Province Police would otherwise investigate, and Nepal Police offices are maintained in those three districts for this purpose. It also deletes clause (c) of section 4(1) and removes the words 'manage and' from a clause of section 8(1). Federal Parliament Secretariat (hr.parliament.gov.np) — ordinance text as tabled in the House of Representatives Sections 2–4 (new s. 10A), PDF pp. 1–2
- Under Article 114 of the Constitution, an ordinance has the same force as an Act, but it must be tabled at the next session of both Houses; it ceases to have effect if both Houses do not adopt it, if the President repeals it, or sixty days after both Houses meet. The House of Representatives' ordinance-status list records it as having become inactive automatically after sixty days from the start of the session. Nepal Law Commission · Federal Parliament of Nepal Article 114(1)–(2), PDF p. 62; Ordinance-status entry/entries
