What does it do?

  • This ordinance amends the Public Procurement Act, 2063 in about 30 places. It was issued under Article 114(1) of the Constitution while the Federal Parliament was not in session. It defines 'domestic goods' as goods made by a domestic industry with at least 30 percent of their value added by domestic labour, raw materials and inputs; imported goods that are only branded in Nepal do not count. Public bodies must give domestic goods the priority set by rules and say so in bid documents. Bids may not be bundled into large packages or split into pieces in ways that limit competition. Nepal Law Commission (lawcommission.gov.np), official text Preamble and Sections 2–3 and 7(6) (Act ss. 2, 8, 14(8a)), PDF pp. 1–2 and 5
  • It adds new ways to buy. These are reverse auctions, where bidders bid down from the cost estimate within a set time, and a government e-marketplace run by the Public Procurement Monitoring Office, where listed goods and services may be bought directly up to a set amount. It also adds a procedure approved by the government for buying fertiliser, medicines, IT and other notified items, and a Government Procurement Service Office under the Office of the Prime Minister and Council of Ministers to help select suppliers. Smaller or non-qualification purchases use a single envelope; larger ones use two envelopes. Nepal Law Commission (lawcommission.gov.np), official text Sections 3, 5, 15–16 and 29 (Act ss. 8(1)(a)(11), 11(4)–(6), 41a, 42a, 66a), PDF pp. 2–3, 9 and 14
  • Bid evaluation changes. The lowest bid is found first and then the bidder's qualification is checked. Building bids more than 30 percent below the approved cost estimate must come with a rate analysis, and are removed if the rates cannot deliver the work. If the lowest bid is well above the estimate, the public body may negotiate a lump-sum discount without lowering specifications or quality. Ties are settled by lottery. Minimum bid notice periods are cut, for example from 30 to 21 days and from 45 to 30 days. The government may call bids with 7 days' notice in special circumstances. Nepal Law Commission (lawcommission.gov.np), official text Sections 7 and 9–11 (Act ss. 14, 25, 26, 27), PDF pp. 4–8
  • For contracts, a mobilisation advance of up to 20 percent of the contract may be paid without a bank guarantee, after the key activities and schedule have been submitted. Variation orders are approved by officials of rising rank: up to 5, 10 and 15 percent, and above 15 percent by the head of department. Public infrastructure work must not be stopped because of disputes between the parties. Public bodies must carry out decisions of the Public Procurement Review Committee, which may seek departmental action against officials who do not. Officials who delay or mishandle procurement may be referred for departmental action. Staff and contractors who finish quality work on time may be rewarded. Nepal Law Commission (lawcommission.gov.np), official text Sections 20–27 (Act ss. 50, 52a, 54, 58a, 59, 61a, 61b, 62a), PDF pp. 11–13
  • Under Article 114 of the Constitution, an ordinance lapses unless both Houses accept it. The House of Representatives' record says this ordinance was approved at its meeting of 2083 Asar 5. The National Assembly's record lists it as 'accepted' (स्वीकार). Nepal Law Commission · House of Representatives, Federal Parliament of Nepal Constitution Art. 114, PDF p. 58; House of Representatives and National Assembly ordinance records, status fields
