What does it do?

  • This ordinance amends the Constitutional Council (Functions, Duties, Powers and Procedures) Act, 2066. The Constitutional Council recommends appointments to constitutional bodies. The ordinance was issued under Article 114(1) of the Constitution while the Federal Parliament was not in session, and it changes Sections 6 and 7 of the Act. Nepal Law Commission (lawcommission.gov.np), official text Preamble and Sections 1–2, PDF p. 1
  • It replaces Section 6 on Council meetings. The chair sets the meeting time, and members get the agenda at least 48 hours ahead; notice may be sent electronically. A quorum is the chair plus at least three members. Decisions are made by consensus if possible, otherwise by majority. A majority means at least three votes including the chair's when the chair and five members are present, and the chair plus at least two members when four or three members are present. The secretary keeps signed minutes. Nepal Law Commission (lawcommission.gov.np), official text Section 2(1) (replacing Act s. 6), PDF pp. 1–2
  • It also changes Section 7, which links nominations to the parliamentary hearing. Once the Federal Parliament Secretariat writes that the hearing raises no bar to an appointment, the Council secretary sends the name to the President's Office for appointment. If the Parliamentary Hearing Committee finds a nominee unsuitable, the Council is informed and must meet again to recommend another person for a hearing. Nepal Law Commission (lawcommission.gov.np), official text Section 2(2) (amending Act s. 7), PDF pp. 2–3
  • Under Article 114(2)(c) of the Constitution, an ordinance that has not otherwise lapsed or been repealed lapses automatically 60 days after both Houses meet. The ordinance records of both the House of Representatives and the National Assembly list this ordinance as inactive under Article 114(2)(c). Nepal Law Commission · House of Representatives, Federal Parliament of Nepal Constitution Art. 114(2)(c), PDF p. 58; House of Representatives and National Assembly ordinance records, status fields
