What does it do?

  • This ordinance amends six health-science academy Acts: the B.P. Koirala Institute of Health Sciences Act, 2049; the National Academy of Medical Sciences Act, 2063; and the Patan (2064), Karnali (2068), Pokhara (2072) and Rapti (2074) Academy of Health Sciences Acts. It was issued under Article 114(1) of the Constitution while the Federal Parliament was not in session. Nepal Law Commission (lawcommission.gov.np), official text Preamble and Sections 1–7, PDF pp. 1–2
  • The changes are all deletions. In each Act it deletes one subsection from each of several sections on the academy's office-bearers, and repeals one whole section: B.P. Koirala Section 11gh, National Academy Section 22, Patan and Karnali Section 26, Pokhara Section 24 and Rapti Section 25. In the Pokhara Act it also removes the word 'term' (पदावधि) from the heading of Section 23 and deletes Section 23(1). Nepal Law Commission (lawcommission.gov.np), official text Sections 2–7, PDF pp. 1–2
  • For context, take the Patan Act. In the Law Commission's consolidated text, the subsections this ordinance names in Sections 20–24 set four-year terms for the Vice-Chancellor, Rector, Registrar, Dean and Hospital Director. Section 26 ('may be removed from office') sets the procedure for removing the Vice-Chancellor, Rector or Registrar. That consolidated text also lists an amending Act with the same name as this ordinance, authenticated 2083-03-25. Nepal Law Commission (lawcommission.gov.np), consolidated text Patan Act consolidated text: amendment list, PDF p. 1; Sections 20–26, PDF pp. 14–15
  • Under Article 114 of the Constitution, an ordinance lapses unless both Houses accept it. The House of Representatives' record says this ordinance was approved at its meeting of 2083 Asar 5. The National Assembly's record lists it as 'accepted' (स्वीकार). Nepal Law Commission · House of Representatives, Federal Parliament of Nepal Constitution Art. 114, PDF p. 58; House of Representatives and National Assembly ordinance records, status fields
