What does it do?

  • The Oath Ordinance, 2078 sets rules for the oath of office and secrecy taken by people who hold public office. It was issued under Article 114(1) of the Constitution while Parliament was not in session, and it does not amend another Act. Anyone holding public office must take the oath before starting work, before the official and in the form set by the Constitution or other law. If a law requires an oath but gives no form, the Schedule form is used. If the law does not require an oath at all, the oath is taken in the Schedule form before an official named by the government. Nepal Law Commission (lawcommission.gov.np), official text Preamble and Sections 1–3, PDF pp. 1–2
  • Oath-takers wear formal dress set by the government, but may instead wear dignified dress that reflects their own culture, tradition or identity. The oath is taken in Nepali, the official language. A person may also take it in their mother tongue spoken in Nepal, after giving the swearing-in official a translation they have certified themselves. Signed copies are kept on record. Nepal Law Commission (lawcommission.gov.np), official text Sections 4–5 and 8, PDF pp. 2–3
  • Office-holders take up their post only after the oath and receive benefits from the date of the oath. Oaths taken before the ordinance began are treated as valid. In the Schedule form, the person pledges full loyalty to the Constitution and promises to work honestly and without fear or favour, and to keep official information secret. The person may swear either 'in the name of God' or 'in the name of the country and people', and must tell the swearing-in official which one beforehand. Nepal Law Commission (lawcommission.gov.np), official text Sections 6–7 and 9 and Schedule, PDF pp. 3–4
  • Under Article 114 of the Constitution, an ordinance must be tabled in both Houses, and it lapses if both Houses do not accept it, and in any case 60 days after both Houses meet. The House of Representatives' record for this ordinance (registered 2078-04-03) says it was 'only tabled in the meetings of both Houses'. Nepal Law Commission · House of Representatives, Federal Parliament of Nepal Constitution Art. 114, PDF p. 58; House of Representatives ordinance record, status field
