What does it do?

  • This ordinance amends the Nepal Citizenship Act, 2063. It provides that the child of a person who obtained citizenship by birth before 2072 Asoj 3 (when the Constitution was promulgated) gets citizenship by descent after turning sixteen if both parents are Nepali citizens. Nepal Law Commission Section 2 (new s. 3(4)), PDF pp. 1–2
  • A person born in Nepal to a Nepali citizen mother, living in Nepal, whose father cannot be identified, gets citizenship by descent on the basis of a self-declaration by the person and the mother (or, if the mother has died or cannot be traced, the applicant's own declaration with evidence). If the father is later found to be a foreign national, that citizenship by descent does not continue and is converted to naturalised citizenship once the person declares they have not taken the father's foreign citizenship. Nepal Law Commission Sections 2–3 (new ss. 3(5)–(6), 8(1)(क1), 8(1क)), PDF pp. 2–3
  • False self-declarations are punished: a false declaration under section 3(6) carries six months to one year in prison or a fine of Rs 50,000–100,000 or both, and a false declaration about an unidentified father carries one to three years or Rs 100,000–300,000 or both; citizenship obtained through a false declaration is automatically cancelled. Nepal Law Commission Section 4 (new s. 21(3क)–(3ख)), PDF p. 3
  • Under Article 114 of the Constitution, an ordinance has the same force as an Act, but it must be tabled at the next session of both Houses; it ceases to have effect if both Houses do not adopt it, if the President repeals it, or sixty days after both Houses meet. The House of Representatives' ordinance-status list records it as only tabled in the meetings of both Houses. Nepal Law Commission · Federal Parliament of Nepal Article 114(1)–(2), PDF p. 62; HoR ordinance-status entry
