Ordinance to amend certain laws against sexual violence, 2078

What does it do?

• This ordinance amends three laws against sexual violence: the Senior Citizens Act 2063, the Muluki Criminal Code 2074 and the Muluki Criminal Procedure Code 2074. The sentence concession given to senior citizens under section 12(1) of the Senior Citizens Act will not apply to rape or to killing, maiming or injuring with acid. • In addition to prison terms for rape, offenders must pay a fine of Rs 600,000, Rs 400,000 or Rs 200,000 depending on the category of the offence, and the fine goes to the victim. • Under Article 114 of the Constitution, an ordinance has the same force as an Act, but it must be tabled at the next session of both Houses; it ceases to have effect if both Houses do not adopt it, if the President repeals it, or sixty days after both Houses meet.
